The Orense Provincial Court sentenced to 10 years in prison the boyfriend of Nerea Añel, the young woman whose body was found eight months after her disappearance in a river bed in Barbadás. Concretely, she considers him responsible for a crime of homicide by default.

The judgment, reported this Monday by the Superior Court of Xustiza de Galicia (TSXG), comes after, last June, the Superior Court of Galicia itself declared null and void the first sentence pronounced by the Provincial Court, for having reached “a conclusion different from that expressed by the jurors, who had heard the accusatory thesis.

For this reason, he ordered that the procedure be brought back to the moment preceding the issuance of the resolution, with the aim of making another sentence consistent with the verdict of guilt pronounced by the jury. And the people’s court understood that the victim’s death was due to the person concerned’s failure to provide assistance.

In the resolution, the judge who presides over the jury court indicates that the accused, as was considered proven in the minutes of the verdict, “was present at the time when the head and spinal cord trauma of the victim and failed to provide him with the assistance necessary to prevent his death“.

It was thus proven that the death of the woman, aged 26, “was caused by the lack of assistance that her partner should have given her after her fall at an undetermined time”.

The jury thus accepts the thesis of the forensic doctors according to which the injuries suffered by the victim were the result of a fall due to precipitation, which they consider mainly accidental. The award is not final, as an appeal may be filed against it to the TSXG.
