The Prosecutor’s Office is appealing to the Supreme Court the archives of the offices of García Ortiz and the Attorney General of the province of Madrid.

The lieutenant prosecutor of the Supreme Court (TS), María Ángeles Sánchez Conde, presented a call before the Supreme Court against the searches carried out last Wednesday in the offices of the State Attorney General, Álvaro García Ortiz, and the Attorney General of the Province of Madrid, Pilar Rodríguez.

The prosecutor’s office indicated in an internal communication to the prosecutor’s office that Sánchez Conde had filed an appeal within the framework of the investigations carried out by the Supreme Court for the alleged revelation of secrets against the boyfriend of the Madrid president, Isabel Díaz Ayuso.

The tax sources consulted by Europa Press specify that this is a resource against entry cars and the recording dictated by the instructor of the file, Ángel Luis Hurtado, which materialized on October 30.

In the case of García Ortiz’s office, there were more than ten hours of registration – from 12:30 p.m. to 11:00 p.m. – which resulted in the deletion of all the contents of his file. two phones -personal and official-, a laptop, a desktop computer, a tablet and a multitude of USB keys.

In the order addressed to García Ortiz, the instructor agreed to seize his electronic devices and the storage of his email accounts from March 8 to October 30, authorizing only access to material related to the alleged revelation of secrets.

The date of March 8 is crucial because, as the Supreme Court itself pointed out when it prosecuted García Ortiz, the prosecutor in charge of the trial against Díaz Ayuso’s boyfriend, Julián Salto, declared that this day was the one where Rodríguez had informed him that the person under investigation for alleged tax crimes She was the companion of Madrid’s president, Alberto González Amador, and “he asked her for a copy of the already approved complaint.”

In addition, the Public Ministry announced through an “infofiscalía” that García Ortiz had extended it to the Supreme Court. abstention which he already accepted for this case when he was before the Superior Court of Justice of Madrid (TSJM) and before the Court of Instruction Number 28 of Madrid.

This means that Sánchez Conde, who is his “number two”, will be exempt from receiving orders from García Ortiz and reporting to him in this matter, thus guaranteeing the independence of the lieutenant prosecutor in decision-making in this legal proceeding.

It is worth remembering that two popular accusations – those brought by the Professional and Independent Association of Prosecutors (APIF) and Manos Cleans – asked Hurtado to provisionally suspend García Ortiz from his functions, precisely because of the hierarchical dependency by Sánchez Condé.

Concretely, with this abstention, they leave predictions without effect of the second paragraph of article 25 and article 26 of the organic statute of the public prosecutor (EOMF).

“This is in accordance with the provisions of the second section of Article 17 of the FMEO, under which the Lieutenant Prosecutor of the Supreme Court will replace the prosecutor general of the State in the event of absence, impossibility or vacancy, since the latter has refrained from intervening from the outset in the accounting or in any other acts” of the present case.

Attorney General’s investigation

On October 16, the Supreme Court opened a trial against García Ortiz, based on complaints filed, among others, by Gonzalez Amador, and the reasoned statement of the Superior Court of Justice of Madrid.

González Amador took the case to court for a note broadcast on March 14 by the prosecution where he learned of the exchange of emails between his lawyer and Salto to negotiate an agreement.

The Supreme Court, however, did not see a crime in the press release, but instead focused on the previous leaks about these “emails” addressed to the media.
