Like a feeling of deja vu. On Monday, November 4, unions and employers once again aired their differences over the solutions to be applied to reduce unemployment among employees at the end of their careers. Meeting for the third time within the framework of negotiations dedicated to the employment of older people, the protagonists dedicated a good part of their discussions to the so-called “experience valorization” contract. This project, which departs from common law to facilitate the hiring of job seekers close to retirement age, is defended by movements representing business leaders. But workers’ organizations are very reserved, as at the beginning of the year, when social actors examined such an idea during the cycle of conversations about a “new pact for life at work”, which ended in failure on April 10.

The system proposed today is very close to the one proposed by businessmen a little over six months ago. This is an experiment in the form of a permanent contract that is open to unemployed people between 60 and 57 years old, if stipulated in a sectoral agreement.

For the company, the imagined system has several advantages. First of all, you have the possibility of ending the employment relationship if your employee is eligible to retire and has reached the age that allows him to receive a full pension. In this scenario, the company does not have to pay the “specific business contribution” of 30% on the amount of the retirement compensation. In addition, they benefit from a “progressive exemption from unemployment insurance contributions” (these reductions increase as the employee ages).

“Incomprehension”

As for the contract holder, a rule is established in his favor: if his remuneration is 30% lower than what he received in his previous position, he is paid compensation, taking into account his remaining unemployment insurance rights. .

At the end of the meeting, the union representatives expressed to the press their reluctance regarding such a mechanism, in particular due to the reductions in contributions it introduces for the benefit of employers. Olivier Guivarch, national secretary of the CFDT, saw it “a breach” in the compensation system for job seekers, which is supposed to “solidarity and sharing”. On behalf of the CGT, Sandrine Mourey expressed her “incomprehension” : Why should special provisions be made for a category of workers? “although we do not want to stigmatize [les seniors] » ? FO confederal secretary Patricia Drevon declared that her organization remains unfavorable to this option, as it did during negotiations for a “new pact for life at work.” For his part, the leader of the CFTC, Frédéric Belouze, used the euphemism: “That raises a real question for us.”he said, noting that the measure was not “not encrypted”.
