An independent trade union central (CSIF) in Asturia transferred to the committee on guarantees the existence of an internal complaint, to clarify whether there is a conflict of interests, allowing the Union of the Union of the current Taxi Transports Union for belonging to the Auti -arepreneurs of Astoria Auti -Auti Association (ASTAXI).
Thanks to this internal complaint, the applicant asks the “immediate” exile of the JMF trade union delegation to the application of Article 9 of the CSIF laws for “double militants” and, if it is not recalled from the organization, she asks that “at least”, the position of the trade union delegate is disconnected.
The applicant says that if his requests are not fulfilled, he will transfer it to the union in Madrid and to the judicial authorities.
Answer CSIF
His claims were the first response from the regional president of CSIF, Sergio Fernandez Pen, where he remembered that the presidents of trade union organizations, such as him, “do not expel and do not put anyone” because their union is democratic and has some laws and applicable rules.
Fernández-Pet confirmed that the resolution of this internal complaint is already referring to the warranty commission, “so that, if necessary, a file, opening with all guarantees.”
Complaint
In this complaint, the trade union delegate is not limited exclusively. Elections to the trade union delegate
The regional president of CSIF, Sergio Fernandez-Pen, denies any irregularity on the part of the trade union in advance, although he warns that the last word has a warranty commission that is a body that will determine whether there is a conflict of interest or not.
Nevertheless, he initially believes that there is no reason for this complaint, and evaluates that it is “completely compatible” belonging to both organizations.
In any case, he believes that the complaint goes to other ways within the framework of the action, which are especially the capes in the war between the associations that CSIF is alien.
“No one disputed the elections”

The applicant, in addition to doubtful of the election of the delegate of the trade union and the request of its “suspension or exile”, also asked the executive commission to announce the provision of the conflict and take as a precaution at the beginning of the disciplinary file against all affiliated persons belonging to the cooperative of the bachelor’s communications.
Among the reasons for which he claims, he indicates that his request is fulfilled because it was “the company’s partners that used them to designate the employer as a delegate of the sector and, thus, paralyze all actions against the specified cooperative, the culmination of which is the expulsion of their violations with the regulation of the Union.”

The basis of this complaint is based on the Assembly’s protocol, where the cooperative admits that he appointed one of his partners as a responsible trade union, which, according to the applicant, will mean that “a brake, in order to avoid judicial claims that can be brought out of their company from the trade union.”
In addition, this contributes to the evidence that not each of them will be paid for ownership, but that the company itself will pay the quota of the Union in accordance with the concept of “Quota CSIF”.
Sanctioning measures
The complaint is also aimed at taking sanction measures, which are considered in internal laws, and which will fit into the suspension or exclusion of the Union, if the submitted documentary evidence has been adopted and ratified.
