Rafa Mir’s complainant told police she went “consensually to the toilet” and the footballer “stopped when he asked her to”.

Rafa Mir’s lawyer, Jaime Campaner, presented a document to the Court of Instruction No. 8 of Llíria, to which EL ESPAÑOL had access, in which he requests that the agents of the local police of Bétera who went to the home of the Valencia CF Player.

Rafa Mir’s defense includes in its brief the report presented by the local police, which it claims exonerates the footballer of the alleged sexual assault reported by a 21-year-old girl.

The local police report says verbatim: “When asked about what happened (the complainant) who was sobbing sitting in the garden of the house, she told the story, indicating that they had met these young people at the Mya discotheque. was affectionate with Rafael Mir all night.”

“When she went to his house, her friend and Rafael started having fun in the taxi, so she felt upset about the situation and argued with her friend.”

“When she got home, she talked to Rafael and told him that he liked her. Later, they agreed to go to the bathroom at home, where they became intimate and Rafael inserted several fingers into her vagina. She told him to stop, they listened to him and they returned to the pool.

These are the verbatim words included in Rafa Mir’s defense brief and which attempt to prove a clear contradiction with what was expressed by the complainant the following day before the Civil Guard.

Likewise, lawyer Jaime Campaner points out that the plaintiff has also incurred “an insurmountable contradiction if ever there was one” by changing her version of what she said to a local police officer on the day of the events.

In her testimony, the complainant told Judge Ana Magraner Naya that she “told everything” to the “women of the police” and that “the others did not know because they would have been separated.”

However, the 21-year-old girl who reported Rafa Mir for sexual assault with carnal access had given a different version of events to the Civil Guard, just two days before this testimony.

The Benemérita report includes the following: “The complainant wishes to point out that after telling everything that had happened to the only female local police officer present at the scene, Rafa Mir had stuck his fingers in her, under her impression “It seemed to her that the male local police officers did not believe what they were saying, not showing much interest in finding out what had happened and even having a relaxed conversation with Rafa Mir and his friend while they laughed.

It is for this reason that the Valencia CF footballer’s defense concludes that the plaintiff “could not offer a reasonable explanation in this regard” when this “insurmountable contradiction” was revealed during the testimony.
