Prosecutor’s Office Requests Investigation into One of the Popular Accusations in Begoña Gómez Case for Leaking Secret Data

The Madrid Public Prosecutor’s Office considers that one of the lawyers who is a prosecutor in the trial opened against Begoña Gómez, Aitor Guisasola, should be investigated for revealing the secrets of the proceedings against the wife of the President of the Government. In a letter, the Public Prosecutor’s Office opposes that Judge Juan Carlos Peinado be investigated for the press releases in which he reported on the case when it was kept secret, but understands that an ordinary court should investigate Guisasola for giving details about the cause of his case. YouTube channel, where he presents himself as “a lawyer against demagogy” and speaks on behalf of the “Movement for the Political Regeneration of Spain”.

The letter from the Public Prosecutor’s Office comes after the communicator Máximo Pradera filed a complaint against the judge and the press officer of the High Court of Madrid, accusing both of having disseminated secret information about the case in the different press releases with which the Court 41 of Madrid informed the public of the developments in the case, for example by communicating the opening of proceedings following the complaint of Manos Médicas.

The case ended up in the hands of the High Court of Madrid, where Judge Peinado sits, also pending the complaints filed against him by Begoña Gómez and the Public Prosecutor’s Office. The Public Prosecutor’s Office, in its report, understands that neither the magistrate nor the employee of the TSJ should be charged or accused of revealing secrets: they are accused “without any evidence,” the Public Prosecutor’s Office states, and the communiqués “do not reveal the content” of the representations.

He understands that an ordinary court in the Plaza de Castilla should investigate one of the popular accusations in this case: Aitor Guisasola. Pradera’s complaint claims that it was this lawyer, appearing in the case, who disseminated a trial order through his X account – formerly Twitter – in which the judge lifted the secrecy of the minutes.

For the Madrid prosecutor’s office, as explained in a statement, this action by Guisasola contains “enough evidence” to open proceedings against him for revealing secrets. “Clear evidence is provided regarding the commission of the crime”, although the TSJ would not be competent.

Guisasola exercises, on behalf of the “Movement for the Political Regeneration of Spain”, the popular prosecution in this case with Manos Médicas, Vox, HazteOír and Iustitia Europa. This is what he informs his followers about on his YouTube channel, where he now has more than 460,000 subscribers.

Two complaints against Peinado

In recent weeks, the High Court of Justice of Madrid has received two complaints filed for embezzlement, among other crimes, against Judge Juan Carlos Peinado, who is leading the criminal investigation against Begoña Gómez. One was presented and recently expanded by the State Public Ministry on behalf of the President of the Government, Pedro Sánchez, and the other by Gómez’s own defense.

The two complaints, pending a report from the prosecutor’s office and a decision from the competent higher court, accuse Peinado of having launched a prospective investigation against the wife of the President of the Government. Procedures in which, they claim, Gómez does not know the reason why she is accused and ignores the instructions of the Provincial Court, in addition to incurring irregularities in the summons as a witness of the President of the Government in his office.
