Madrid, Aragon, Castile-La Mancha and the Parliament of Cantabria file appeals against the amnesty

The communities in the hands of the PP – to which Castilla-La Mancha adheres – began on Monday to present appeals against the amnesty law, as they had announced. Madrid, Aragon, Castilla-La Mancha and the Parliament of Cantabria have already made it official. Other autonomies such as Murcia, Andalusia and the Comunitat Valenciana have announced their intention to do so throughout the day.

The spokesperson for the Socialist Government of Castilla-La Mancha, Esther Padilla, confirmed that the Regional Government, chaired by Emiliano García-Page, presented the appeal of unconstitutionality electronically this Monday morning. In July, the Governing Council approved the appearance and presentation of this appeal following a report from the Consultative Council at the request of the regional president. This report was “very firm about the legitimacy of the community to be able to present this appeal” and also stressed that the amnesty law “is an unconstitutional law because it breaks the principle of equality between citizens,” said the spokesperson.

In the case of Madrid, the appeal also includes the request for the recusal of judges Juan Carlos Campo, Cándido Conde-Pumpido and Laura Díez due to “their connection with the PSOE”, according to Ayuso. At the same time, the text presented by the Government of Aragon considers that there is “a total failure of the rule of law, enshrined in Article 1 of the Constitution, due to the violation of the superior value of justice and the principle of separation of powers, so that political power is excluded from judicial control.

The Cantabrian case is a little different. It was the Parliament of Cantabria that filed an appeal of unconstitutionality before the Constitutional Court because, according to it, “it violates the principle of equality between Spaniards”. The PSOE voted against, while the PP and Vox voted for and the PRC abstained. This is the second time in the history of the Parliament that it has filed an appeal for unconstitutionality.

Others will do it throughout the day.

The Valencian Government will meet this Monday afternoon in an extraordinary session to approve the presentation to the Constitutional Court of the announced appeal against the amnesty law, as confirmed by sources from the Presidency of the Generalitat. The “president” of the Generalitat, Carlos Mazón, will preside at 5 p.m. over the extraordinary session of the plenary session and, at the end, he will appear in the Gothic courtyard of the Palau to report on what has been agreed.

In the case of Murcia, its president, Fernando López Miras, announced that he would present it throughout Monday and described the amnesty as “shameful”, considering that it generates “more inequality among Spaniards” and “violates the separation of powers”. “Andalusia also plans to present it this Monday.

La Rioja decides on Tuesday

The government of La Rioja will decide on Tuesday, at the weekly meeting of the Government Council, whether to appeal the amnesty law, after analyzing it with the Consultative Council, as reported by its spokesman, Alfonso Domínguez. The Executive of La Rioja is still analyzing “the last margins” and the “legal arguments” to decide whether to appeal the amnesty law before the Constitutional Court.
