Judge rules out requesting Ábalos’ indictment in Koldo case for now

The judge in charge of the investigation into the Koldo case at the National Court considers that “to date, there are no sufficient reasons” to ask the Supreme Court to appoint former minister José Luis Ábalos as investigator, “without prejudice to what may result in the future” because “the execution of various procedures” is underway.

In an order notified this Monday and to which ABC had access, Judge Ismael Moreno ruled in these terms following the request for indictment that had been filed by the popular accusation exercised by Iustitia Europa, and that he had requested in writing that a reasoned statement be submitted to the Supreme Court given Ábalos’ status as a deputy in Congress.

The judge requested a report from the anti-corruption prosecutor’s office, which addressed the matter by specifying that “given the state of the proceedings, with various ongoing proceedings – testimonies, interrogations of the persons investigated and police reports on the result of the spilling of the effects of digital interceptions – it is considered that to date there is not enough evidence that could support the Ilmo. Mr. Investigator will have to submit a reasoned statement to the Second Chamber of the Supreme Court.

This was finally the decision of the judge, who concluded that “at this stage of the proceedings, there is no reason to present a reasoned statement to the Second Chamber of the Supreme Court, regarding Mr. Ábalos Meco, given his status as a certified person”, this without prejudice to what may result in the future, as a consequence of the procedures carried out and the outcome of the investigation.

Prosecutor’s report on Ábalos as a victim

At the same time, in another separate resolution, he questions the prosecution on the request made by Ábalos himself, who asked to enter the proceedings as an injured party and that a counter-expertise on the audit of contracts carried out by Minister Óscar be deemed to have been provided to the Ministry of Transport.

The resolution, which ABC has had access to, requests that Anticorruption “report on the origin or not” of the fact of considering him as an injured person “and, consequently, on the belonging or not of the documents attached to this procedure.” presentation document.

A senior Adif official will be witness

The same order, however, agrees to carry out part of these procedures, requested in this case by the popular accusation led by Liberum. It cites as a witness the financial and management control director of ADIF, Manuel Fresno Castro, as an expert in the purchase of masks from the instrumental company Soluciones de Gestión carried out by this body dependent on the Ministry of Transport.

Fresno was summoned on September 16, as part of the group of witnesses called to state court that week.
