Violence against women court to hear case of Ertzaina who changed sex

The Instruction Court number 4 of Donostia has agreed to recuse itself in favour of the Court of Violence against Women in the case of the ertzaina arrested for trying to attack her partner with a knife and who, a few months before, had registered her change of sex in the civil registry, as confirmed to Europa Press by sources from the TSJPV.

The events occurred in the early hours of Saturday, August 17, in a house in the Loyola neighborhood of San Sebastian, when Ertzaina, on medical leave, allegedly tried to attack his partner with a knife and threatened to hurt his two daughters.

The victim managed to alert the Ertzaintza, who went to the house and arrested the alleged aggressor, initially accused of the crime of gender-based violence and domestic violence. After being brought to court, the accused was released with precautionary measures and with the obligation to appear before the judge when required.

Later, it was learned that this ertzaina had registered his gender change in the civil registry in November 2023, a fact that could condition the accusation brought against him, since initially, when he was arrested, he was accused of crimes of gender violence and domestic violence. Finally, the Instruction Court number 4 of Donostia decided that the case would be brought before the Court of Violence against Women.
