The federal government must comply with the obligations to reception that it provided, especially to disappear Afghan. This arises as a result of immersion in the Berlin Administrative Court. It is only about a particular case of an individual doctor of Afghan Yura and her family members. Nevertheless, the main reasoning of the judges of the eighth chamber should also be applied to everyone else who received an obligation.
The premise for a court decision is a constant dispute in the Black-Red Federal Government regarding the processing of the federal recording program for Afghan, which is especially threateing the Islamic Taliban regime in Kabul. Officially, the program ended around the year, new obligations to enter are no longer received.
Nevertheless, this is open what is happening with people who have already been selected, received obligations by recording, have passed numerous security controls – but have not yet been treated. More than 2000 of them are currently in the Pakistani capital of Islamabad and are desperately waiting for evacuation. Among them is also a woman who was now in court.
SPD, I agree on the left and greens
While SPD politicians, as well as the opposition of the left and green, demand that these people be scared, the union does not want this. The head of the CDU CDU, Torsten Frey announced a few weeks ago that they want to take on obligations.
After a court decision on Tuesday, this should be much more complicated. The court clearly claims that the obligations on admission will not be ineffective from the fact that the actual program has ended. Therefore, the Afghans and their relatives would have to receive a visa.
Joy on Monday was a great among supporters. The press secretary of the organization Kabul Luftbrücke told TAZ: “Reception obligations are legally obligatory.” The federal government should adhere to this “and should not simply expose the entire program, because it is politically dissatisfied.” And the home press secretary on the left in the Bundestag Clara Buner said that if the federal government continues to issue a visa, this is “not only morally reprehensible, but also illegal.”
Nevertheless, the federal government can still file a complaint against a court decision in the Berlin Supreme Administrative Court. And time plays against Afghan who has ended up in Pakistan. The government in Islamabad is currently trying to deport as many Afghans as possible to the country of its origin, and people from the German recording program are also affected.
Deportation is prevented in the last second
According to activists, the deportation of two Afghan families with an assumption obligation was provided only in the last second at the end of June. Eleven injured people were already arrested by the Pakistani police and delivered to the Haji deportation camp. Only thanks to the intervention of the German message were they released again.
The Federal Foreign Ministry did not want to confirm these reports when he was asked by TAZ. From the office it was said that all of them can at any time turn to the operator of their housing in emergency situations. The German embassy in Islamabad also established an emergency mechanism to prevent deportation. Nevertheless, it is doubtful how long the Pakistani authorities can still be proposed if the Ministry of Federal Government of the GUS publicly announced that they did not want to accept Afghan.
