Justice left a year in the prison of Carlo Ancheelotti, the national coach of Brazil, and until several months ago, the Real Madrid coach, because he deceived almost 400,000 euros in 2014. The magistrates of the provincial court understand that this year their second season as a coach in Spain acts with a “conscious will to avoid payment tax”, which are withdrawn from their image rights using the “artic mechanism”.
The prosecutor’s office came to ask for almost five years of prison for him. The condemnation of the technique does not imply his obligatory accession: he has no criminal record, and Real Madrid has already paid his debts on his behalf, in total almost one and a half euros.
Anyone who was the Real Madrid coach until May last year was on the bench of the provincial court of capital on the same charges as several dozen football players in recent years: to pay money for their image rights illegally and stop paying taxes. In his case, he is accused of using the “corporate complex” to ensure that, during the first two years, a statement about its IRPF has been released as a technique in Valdebas in the period from 2014 to 2015 to return to lower his income from the right of image. More than one and a half million than for these two years, the club paid a British society, and not personally to the coach.
In the first year of 2014, as states, it was proved that Anchalotti did not pay bills for 1.2 million, which introduced the rights to the image, having stopped paying 386,000 euros for his personal income tax, given that this year Asenda even returned almost 40,000 euros. The accusations against a similar operation unfolded a year are not a crime, the provincial court explains, because this year he no longer lived in Madrid, since he left Spain in May to settle in England and then sign with Munich.
Judges say about Anchalotti that they said in several sentences of similar cases of football players. The fact that the technician created the “structure of companies” in order to abandon his rights to the image with the aim: “avoid tax” of this income. During the trial, Anchalotti defended, knowing nothing about those empty companies that directed their income, but the judges emphasize that he signed each of the documents. “He participated in the preparation of the contract,” says the court.
He did it “intentionally”
In their financial statements, the judges regulated, did not include their income from the rights to the image “intentionally”. These companies were created “to avoid paying taxes that he was forced as a natural person.” One of these companies was based on the Virgin Islands, a much more favorable financial option than paying income tax or corporation in Spain. Real Madrid, emphasizes the verdict, paid “executed” by Anchelotti’s image rights that the club operated in total.
The second financial crime was associated with the same administration of their rights by image, but with the details: to decide whether this year has lived for many days in Spain in order to consider it a fiscal resident of Madrid. In the same year, shortly after he stopped in the final of the Champions League and Kopa -Doda -rey, and also lost options to win the league, Anchalotti left Real Madrid and moved to London in May. He spent more than 183 days of this year abroad before joining Bavaria Munich German in the middle of -2016.
In this case, the court understands that there is a “reasonable doubt” regarding where 2015 should be taxed, since Anchalotti submitted a financial statement in Madrid and another in London.
His one -time imprisonment does not imply his obligatory entry into prison, having no story and paying what he owes, although it was partly for the embargo of the Gasyenda.
