Fulton County Judge (Georgia) Scott McAfee dismissed three counts on Thursdayincluding two against former US President Donald Trump, current Republican candidate, in the cases of alleged interference in the 2020 election, which Trump lost to US President Joe BidenIn his ruling Thursday, Judge McAfee dismissed the charges against Trump related to the submission of the transcript. Initially, Donald Trump faced 13 charges, including filing false statements about the 2020 election. After the dismissal, Trump still faces eight, after already having three other charges dismissed.
The charges in question – Count 14, presenting false documents; Count 15, attempted presenting false documents; and Count 27, criminal conspiracy to present false documents – relate primarily to the meeting of Trump’s 16 electors on December 14, 2020 to vote for the incumbent president even though he lost the state of GeorgiaThe voters signed certificates that were mailed to the National Archives, Congress and the federal court, documents that the Democratic attorney general says are forged.
At Thursday’s sentencing, as previously reported, McAfee denied all three charges, relying on the Supremacy Clause of the U.S. Constitution, which prohibits state prosecutions for activities that fall under federal jurisdiction. “The Supremacy Clause states that state law must defer to federal law in the event of a conflict between the two.” he explained in his sentence.
Trump still faces eight counts in the case. He was originally charged with 13. The sentence comes at a time when the The fate of the Georgian case is in question, as it was implicated in a controversy earlier this year, when Trump and other defendants denounced Fulton County District Attorney Fani T. Willis and the lead prosecutor in the case, both Democrats, for professional misconduct because they were romantically involved. McAfee has refused to remove Willis or his office from the case. Instead, the case is being stopped because Georgia Court of Appeals A hearing is scheduled for December to decide whether Willis can continue to pursue the case.
