The Madrid prosecutor’s office has requested 15 months in prison for JG A, a man who painted a nazi swastika cross “oversized” in a bolardo near a synagogue in Madrid. The representative of the Public Prosecutor accuses him of crimes against dignity. He judgement will be celebrated on next tuesday at the Provincial Court of Madrid.
According to the prosecutor, between 00:17 and 00:21 on July 31, 2021, the accused went to the Beth Yaakov synagogue in Madrid to: “moved by his prejudices against people who profess the Jewish faith“, painting a “large” Nazi swastika cross on a marker located a few meters from the front door of the synagogue, while people were inside and in an area where there was high visibility.
The graffiti, which evokes the best-known official emblem of the German National Socialist Party, has generated a great “negative” impact and “concern” among members of the Jewish community in Madrid.
The action constitutes an attack on the dignity of the recipients, “by representing, through its degrading and contemptuous nature, a trivialization of the Jewish genocide, as well as of the exaltation of the figure of Hitler and of the political and social regime that he established, founded in the superiority of the Aryan race with submission and contempt for various groups that he considered an inferior race,” according to the prosecution.
Similarly, to avoid this negative impact, we have proceeded to cleaning the terminals by the municipal council, generating 25 euro fee “for which he claims to be compensated.”
In terms of liability, the prosecution is demanding compensation for 1,500 euros to the Jewish Community of Madrid in the amount of 1,500 euros” for moral damages caused” and Madrid City Hall in the amount of 25 euros for the costs incurred for cleaning the terminal.
