Constitutional Commission orders study on whether LACC can appeal amnesty even if it does not affect its powers

The Constitutional Court has instructed a team of lawyers to study Whether the autonomous communities can appeal the amnesty although it is a law that does not affect their powers, as legal sources confirm to ‘laSexta’. With this study, the resources will not be suspended but will all be grouped in the same procedure and the opinion of the lawyers will be applied to all the resources.

A group of constitutional lawyers will prepare a preliminary study to analyze the legitimacy that arises in all the resources of the communities, taking advantage of the first presented to solve a problem that affects the rest of the communities. 15 challenges to the measure of grace for people prosecuted for the Catalan independence process.

He The main appeal will be the one presented by Aragonwhich was the first community to challenge the amnesty law, and the person responsible for said procedure is Judge Laura Díez, so she will be the first to bring her proposal to the plenary session to admit or not these resources.

TC sources clarified that the preparation of the study does not mean that community resources are suspended because “work is already underway on them.” Instead, they argue that “jointly solving” a problem that affects all challenges saves study time. They also expressed their willingness to resolve regional calls without haste, as these are complex issues that require time to be studied.

The legal deadline set for the autonomous communities to file appeals for unconstitutionality before the closing of the TC last Wednesday with a total of 16 appeals against the amnestyAmong them is the procedure opened by Castilla-La Mancha, governed by Emiliano García-Page, as well as the rest of the 15 regions of the PP.
