The High Court of Justice of the Balearic Islands (TSJIB) has confirmed the sentenced to eight and a half years in prison for attempted murder imposed on a man for stabbing a doctor who was treating him. The sentence of the Provincial Court, now ratified, prohibits him from approaching within 500 meters of the victim, from communicating with her for 15 years and from going to the clinic, in addition to compensating her with 8,250 euros.
Furthermore, He will have to leave the country after serving three-quarters of his sentence. -The accused is from the Dominican Republic- and will not be able to return to Spain for 10 years.
The confirmed sentence states that the accused was being treated by the victim in the treatment room of a medical center. The doctor warned that he was being recorded with his mobile phone without his consent, so he warned that he was going to turn it off; once his back was turned, the accused took a pair of surgical scissors and, surprisingly, stabbed him several times in the neck and chest, reports Europa Press.
The court justifies its decision in the following manner: “an undeniable aggressive predisposition made reality by a personal attack behind the victim’s back”for which he used “the scissors that he had provided him with a few moments before actually receiving medical care and which he had first pulled against the jugular area, then against the chest, and also against the trapezius of the victim”.
“The homicidal potential of the instrument used – the court continues – its acquisition before the incident in which the attack was carried out and the number of times it was fired against areas dangerous to life allowed the court of first instance to conclude that it was neither erroneous nor unreasonable as to the presence of a homicidal spirit.
The magistrates concluded that the assault ended without “voluntary interruption” on the part of the attacker, but rather “forced by force when the scissors were taken from him”.
An appeal against the sentence may be lodged with the Supreme Court.
