Prosecutor’s Office Protects Ábalos and Files Complaint for Revealing Secrets in the “Koldo Case”

THE Madrid Provincial Prosecutor’s Office filed a complaint following the request of the former minister Jose Luis Abalos investigate the alleged commission of a crime of revealing secrets and another of omission of the obligation to pursue illegal acts within the framework of the Koldo case. The former head of Public Works presented a letter to the Public Prosecutor’s Office on July 24, 2024. However, as OKDIARIO learned, the prosecutor in charge of investigating the case confirms “the file a complaintwhich was presented to the Dean of the Courts of Instruction of Madrid, pending its distribution.

In his complaint for revelation of secrets and communicationsThe former socialist minister has requested that those responsible for the dissemination of private documents concerning him personally and his entourage be investigated.

In this sense, the requested investigation “is aimed at those who have the obligation to preserve this private life, who are none other than the officials who participated in the investigation and
who were its guardians.

In the letter sent to the prosecutor’s office last July, Ábalos also stressed that “no action had been initiated by the Civil Guard nor for him Judge» to detect “where they come from” the private material information published by certain media.

Addresses and emails

According to sources close to Ábalos consulted by OKDIARIO, the former socialist leader believes that in these events the Ministry of the Interior would have been involvedlet it be “by action or omission“Among the data disclosed, some are sensitive, such as address from their home or e-mails submitted during his term as minister.

Although Ábalos did not explicitly address his complaint against the Interior, the description of the events and his personal conviction clearly point to the ministry led by Great Marlaska: “There is a belief that the leak of this intimate and personal data occurred with the consent of the leaders of the Interior or, at least, with their neglect” Hence the mention of liability “for action or omission”.

The leaked data was found in documents collected during the investigation into the Koldo casewho examines the allegations corruption network linked to Koldo Garciaministerial advisor and close businessmen. Although these personal data of Ábalos were included in the summary documents, they were not included in the judicial investigation. It is worth remembering that Ábalos is not chargedso that some of the documentation should have remained confidential, particularly due to the sensitive nature of the information which affects both your privacy and security.

Last February, Ábalos was fired on Sánchez’s orders, although he was not charged. Koldo case nor in any other cause of corruption. As a result, he became a person importun within the PSOE, and even he had to resign as a deputy, a request he refused. Since then, he has been an independent deputy and is part of the Joint Group of the Congress.

Mark the distances

In this context, knowing that the Public Prosecutor’s Office protected him, Ábalos expressed your dissatisfaction with the audit carried out by the Ministry of Transport regarding Koldo case. In this audit, the order of double the purchase of masks to the plot linked to his then advisor, Koldo García Izaguirre. Ábalos warned that from now on, will vote in Congress “in conscience”, suggesting that he could stop supporting the PSOE. “More than a report or an audit, this looks like a court of honor, which is prohibited by the Constitution,” he said.

The former minister says he did not expect such an attitude from his party and claims the report should have been ordered by a judgeor at least, the ministry should have informed the judicial authority in charge of the investigation at the National Court. He calls Puente a “vigilante” and believes that there was a “hostile and intentional attitude” on the part of the socialists, a position that he cannot understand. “It is absurd that someone who has left claims to be a judge,” he said.

Thus, Ábalos went further to suggest that he might stop voting aligned with the PSOE in Congress. He warned that from now on, the Government “cannot be taken for granted” his support, including on issues such as the economic agreement for Catalonia, and that he will make his decisions “in conscience” based on each case. “We will examine each case,” he explains and promises to align himself with the PSOE’s electoral program: “I am not going to enter into a situation of contradiction or reprisals.”
