The Administrative Court of Sports annuls the elections for the presidency of the RFEF

The power vacuum in Royal Spanish Football Federation will continue indefinitely. It Administrative Court of Sports on the 9th annulled the agreement of the Management Commission of the Spanish Football Federation, by which it called elections for the presidency of this body to end the 2020-2024 term after the disqualification of Pedro Rocha.

This happens after Miguel Galan, the president of CENAFE, filed an appeal against the holding of these elections since the General Assembly of the Federation had not pronounced the dismissal of Pedro Rocha as president.

The TAD therefore considers that the disqualification of Pedro Rocha for two years does not immediately lead to his suspension from his duties. That is to say, the Court emphasizes that according to the statutes of the Federation itself, it is the General Assembly that must decide on this termination, and that consequently article 31.8 of this regulation cannot be applied as the RFEF has done, for coto create its management committee and call elections for the position of president.

The TAD says in its resolution that it cannot understand how the cessation of Pedro Rocha in his functions as president of the Federation has taken place, since there is no firm resolution of the General meeting this indicates it. Therefore, the first necessary step is not taken to cease having any relationship with the position.

Article 31.8 of the RFEF Statutes indicates that “if the President were to leave for reasons other than the end of his term, the Board of Directors He will form a management committee and call elections to fill the position; “The person elected will hold the position for a period equal to the time remaining to be filled by the person replaced.”

On the other hand, in the appeal filed by Miguel Galan It was also pointed out that these elections were contrary to the norm since the current mandate of Pedro Rocha provided for the time that would have been lacking for Luis Rubiales to conclude yours. That is a period of less than six months.

Paralyzed elections

On September 9, the Royal Spanish Football Federation announced the call for presidential elections after the disqualification of Pedro Rocha.

This Friday, it was expected that the RFEF Electoral Commission definitively proclaim president Maria Angeles García Chavesafter confirming her three days ago as the only candidate for the presidency, to the detriment of possible resources.

The elections were scheduled for October 7. According to the deadlines published by the RFEF in its press release, the deadline for submitting candidacies opened on September 12 and closed on the 18th of this month.

But today, everything is paralyzed again and scandals continue to shake a Federation that is experiencing the worst institutional moments in its entire history.
