THE First Section of the Court of Navarre sentenced to three years and three months in prison a resident of a town in the Middle Zone of Navarre who possessed of narcotic substances intended for sale valued at 16,998 euros.
The facts declared proven in the sentence, pronounced in accordance with an agreement between the prosecution and the defense, constitute a crime against public health, for substance trafficking which cause serious damage to health, with the agreement of substance abuse mitigationas reported by Superior Court of Justice of Navarre in a note.
The judicial resolution considers that it has been proven that, at his home, the defendant, aged 30, for several years toxic drugs stored and sold and narcotics, with a view to distributing them to third parties, either for payment or free of charge, without prejudice to the fact that he was also a consumer of the narcotics in which he trafficked.
On April 13, 2022, the entry and search was carried out at his home, authorized by the Court of First Instance and Instruction No. 1 of Tafalla. In total, it contained 1,536.98 grams of cannabis10.72 grams of cocaine59.48 grams of amphetamine and 9.38 grams of ketamine.
In addition, among other utensils, it contained elements for handling, mixing substances and dispensing dosesas well as a precision electronic balance, equipment used to weigh the doses which would then be put on sale.
The accused is consumer of several narcotic substances. In fact, he was admitted to Proyecto Hombre for two months in 2018 until he went to prison. After leaving the penitentiary center for this reason, in October 2022 he began treatment in an outpatient drug addiction center “with positive results”.
In addition to the above prison sentencethe sentence condemns the defendant to pay a fine of 17,000 euros, with subsidiary personal liability of 4 months of deprivation of liberty in the event of total non-payment.
