Valencian justice is processing four complaints and complaints against President Carlos Mazón, according to sources from the Superior Court of Justice of the Valencian Community (TSJ-CV). These are complaints and complaints filed before the Criminal and Civil Chamber of the TSJ-CV and before two investigating courts in Valencia.
One of these courts – the Court of Instruction number 20 of Valencia, the first to have opened a preliminary procedure for the death of a person in the capital for the corresponding autopsy, being on duty on the day in question – has rejected his counterpart’s ban. at number 15 for having considered the complaint of the ultra pseudo-union Manos Cleans as “premature” and not having appreciated at this procedural moment a “causal link” between the events he recounts and the death of a resident of the La Tour district for which the court initially initiated its proceedings. Clean Hands denounced the Hydrographic Confederation of Júcar (CHJ), Aemet and the Valencian Security and Emergency Response Agency, dependent on the Mazón executive.
In the criminal area, a total of four complaints and complaints are being processed. A fifth complainant (an individual) was summoned to complete his complaint with a special power of attorney to file it.
The first complaint against Carlos Mazón was filed before the Civil and Criminal Chamber of the TSJ-CV by the far-right organization Iustitia Europa. It is currently in the process, after having been ratified. However, she is awaiting the decision rendered by the Chamber of the Regional High Court (the only one authorized to investigate a certified person) on competence and admission or inadmissibility.
The CGT union reported Mazón to the Valencia provincial prosecutor’s office for alleged offenses against workers’ rights. The public prosecutor transmitted the complaint to the TSJ-CV after having read the file of the previous complaint filed by Iustitia Europa. He is in the same situation, awaiting the decision of the TSJ-CV.
In addition, there is a second complaint filed by an individual, a lawyer, against the President of the Generalitat, also pending and awaiting the decision of the Superior Autonomous Court.
On the other hand, there is a third complaint, also from a lawyer, against Mazón and the current Minister of Justice and Interior, Salomé Pradas, whose announced dismissal has not yet been published in the Official Gazette of the Generalitat Valenciana.
Procedural fault of the “Hazte Oír”
Also within the framework of criminal proceedings, the Court of Instruction number 10 of Valencia declared inadmissible for formal defects the complaint of the ultra-conservative organization Hazte Oír against the Government delegate in the Valencian Community, Pilar Bernabé. The organization did not present a special but general power.
It is therefore inadmissible due to a correctable procedural defect linked to the power of attorney.
Two contentious appeals
Added to this are two contentious-administrative appeals. The first was filed by Liberum, another ultra organization which requested extremely cautious measures against the Valencia government delegation. The fourth section of the Contentious-Administrative Chamber of the TSJ-CV declared itself incompetent to rule because the appeal was directed against the central Government and was inhibited in favor of the third chamber of the Supreme Court.
The second appeal was presented by a lawyer for inaction against the president of the Generalitat Valenciana and the management of the Valencian Security and Emergency Response Agency.
The same section of the Contentious-Administrative Chamber of the TSJ-CV admitted him for processing and sent a letter to the regional administration to hand over the administrative files.
