Equality Minister laments Supreme Court ruling ‘whitewashes’ surrogacy

The Minister of Equality, Ana Redondo, regretted the “Whitewashing” by the Supreme Court of surrogacy in a judgment that authorizes the parents of a child born by this method to change in the civil status the place of birth abroad to that of the family home in Spain.

“After carefully analyzing the Supreme Court’s decision regarding surrogacy, respect the independence of the judiciary“I regret that the resolution whitewashes, through the civil registry, this form of violence against women that is prohibited in Spain,” Redondo said in a message published this Sunday on his account on the social network X.

This is a pioneering decision in surrogacy and also controversial, because in a way supports this method of reproduction, which is illegal in Spain. Given that until now the change of place of birth was only provided for cases of international adoptions, in taking this decision, the Supreme Court explains that it is trying to avoid a situation of “discrimination” occurring between the two situations.

Advertising the registration of a certain place of birth abroad which would appear, for example, on your national identity document or passport, would violate the minor’s right to privacybecause it reveals the existence of the adoption and the circumstances linked to its origin, which would imply discrimination in relation to other affiliations (in particular international adoption) which is not justified, the judgment concludes.
