The Court of Castellón sentenced 10 years of prison a tennis teacher for continuously sexually assaulting a woman schoolgirl of 14 years old the one he got pregnant with.
The sentence, which considers the very nuanced mitigating circumstance of compensation for the damage, disabled to the accused for any profession, trade or activity which involves contact regular and direct with minors adult for a period of 20 years, and sentences him to supervised release for compliance after a deprivation of liberty of 10 years.
In addition, the accused cannot approach at a distance of at least 500 meters from the victim for a period of 10 years exceeding the prison sentence or communicate with her during the same period.
Finally, the sentence condemns the defendant to compensate the minor for 50,000 euros for moral damage and 1,955 euros to the Generalitat Valenciana for the assistance provided to the minor.
The conviction establishes as proven facts that between September 2022 and April 2023 the defendant, in his capacity as the victim’s tennis teacher, was 14 years old at the time of the facts, and using the trust that his parents had in him from the youngest, he began to devote more devotion to her than to the rest of the students.
So, he picked her up from her home to take her to training and took her, in addition to the tennis court, to a house he owned located in La Uixó Valley (Castellón), where there is a gym under the pretext of doing physical training.
It was in this house that the accused, “with the clear intention of satisfying his sexual desires”, sexually abused the minor. On April 23, 2023, the minor told the accused that she was not having her period. When he found out, he got down on his knees and begged at least I didn’t say nothing to them parents and that he would tell them that he had had sex with another minor and that nothing would happen, because if he told them it was him, they would put him in prison.
Following this forced sexual contact, the minor was pregnant and carried out a voluntary termination of pregnancy in a hospital, which resulted in treatment costs of 1,955.90 euros. In October 2024, the accused voluntarily deposited 43,955.90 euros in the Provincial Court to cover, in addition to the amount previously deposited, the compensation requested by the prosecutor of the minor and the Generalitat.
