Iustitia Europa sues Conde-Pumpido for prevarication and demands suspension of TC plenary session on amnesty

The political movement Iustitia Europa, which exercises popular accusation in the affairs Begoña Gómez, Koldo and David Sánchezfiled a complaint with the Supreme Court against the president of the Constitutional Court, Cándido Conde-Pumpido, for speaking out when Judge Juan Carlos Campo abstained despite his recusal.

The political group considers that there is an alleged lack of judicial impartiality since the participation, as president, in the decision of abstention of Judge Juan Carlos Campo, constitutes a violation of the principle of judicial impartiality contained in article 24 of the Spanish Constitution and in article 6 of the European Convention on Human Rights.

As we have detailed, one of the most delicate aspects of the complaint is the implication that this action could have for judicial independence in Spain. The judicial system, as they explain, is based on the trust of citizens that their judges and magistrates act with complete independence and without any form of external pressure or special interest that would compromise their decisions.

Judicial independence is a principle enshrined in Article 117 of the Spanish Constitution, which guarantees that judges are independent, irremovable, responsible and subject only to the rule of law, they add.
