Conviction. A magistrate sentenced former media director Saül Gordillo to a year in prison for non-consensual touching in 2022 of one of the journalists of the digital channel he managed, Principal, during the party which followed the dinner of Christmas.
The trial revealed two opposing versions of consent. The accused manager, aged 50 at the time of the facts compared to 23 for the victim, alleged that the young journalist had flirted with him before arriving at the Apolo nightclub and took him by the hand to cross the dance floor. dance, which he understood as approval.
On the contrary, the young woman’s defense, provided by lawyer Noe Martí, and the prosecution, denied the existence of any consent. “Holding hands and crossing the floor of a nightclub is not consent,” concluded prosecutor Pilar Izaguirre.
The public and private lawsuits seek two and four years in prison, respectively, arguing that in addition to touching her buttocks, his hand reached under her pant leg and made other contact without consent, which Gordillo has denied. In her judgment, Judge Maria del Pilar Calvo ruled in favor of the theory of the charges and sentenced Gordillo for the crime of sexual assault in her minimum sentence.
He also sentences Gordillo to two years of supervised release, during which time he will be prohibited from communicating with the victim and will be prohibited from working in professions involving contact with minors.
