What is the reason why the decisions of the Cabinet of Ministers on the determination of non-working days do not include those who work with a six-day work week?

From the Ministry of Labor and Social Protection of the Population Oku.AzIn response to the query, it was stated that this matter is regulated according to the Labor Code.

“According to article 90 of the Labor Code (Determination of weekly full-time working time – ed.), as a general rule, a working week is defined as five days with two days of rest.

At the same time, employers can determine a six-day work week with one day off based on the nature of work, production and working conditions. At this time, the working time norm of a five-day work week must be taken into account.

Consequently, by decision of the Board of the Ministry, the norm of working time and the production calendar are approved in accordance with the five-day working week. For this reason, the final decision of the Cabinet of Ministers applies to those who work with a five-day work week.

In workplaces where the six-day working day is applied, employers can independently regulate the rules governing the working day,” the information states.

It should be noted that according to paragraph 3 of Article 90 of the Labor Code, if the weekly norm is 40 hours in a six-day working week, the daily working day is seven hours, if the weekly norm is 36 hours, the day’s working time is six hours, and if the weekly norm is 24 hours, the duration of daily work cannot exceed four hours.
