Section 23 of the Provincial Court of Madrid has agreed to suspend the deliberation and judgment session during which it was to rule this Monday on the appeals requesting the filing of the file investigated by Court number 41 of Madrid concerning Begoña Gómez, the wife of the president of the government.
In an order notified this Monday, they accepted the suspension because they lack documents and specifically, because in the letter of referral by which they were sent all the documents on the case, “the existence of a direct appeal is verified” the defense of Begoña Gómez to which “no reference was made” and which is the key to the deliberation.
“This must be clarified by the lawyer of the Administration of Justice of the Court of Instruction number 41 of Madrid,” specifies the judgment, against which an appeal can be lodged within 3 days.
It thus indicates the person responsible for processing the documentation, who goes to the Provincial Court with a referral letter detailing the attached contents and the testimonies or aspects of the file that each party wishes to submit for examination in favor of its own allegations.
According to the aforementioned judgment, although Gomez’s defense appeal exists, nothing was said about its existence in the document that listed all the documents “nor in the brief testimony that accompanies it.” It should be remembered that the magistrates asked the court for the entire file to be able to rule, as the documentation they had received to constitute a criterion was “short”.
The deliberation and judgment of an appeal crucial to the continuation of the investigation are thus postponed and without a date because the defense requests that all procedures be archived. The magistrates could thus decide to close the file or keep it open without further delay, but also to limit its scope by leaving aside certain facts and concentrating the investigation on those who, in their opinion, have elements solid evidence.
