The prosecution requested 196 years in prison for the five accused of sexually assaulting three women in 2021 in Barcelona, known as the Castelldefels herd. In addition, they recorded a fourth woman without her consent while she was having relations with one of the group members and distributed the video in a WhatsApp group.
The public prosecutor understands that the defendants formed a “criminal group for the commission of crimes against sexual compensation. According to his writings, he attributes to them three crimes of sexual assault with penetration (two of them continued) and two crimes of discovery and revelation of secrets with distribution of personal data.
Concerning the account of the events, the Prosecutor’s Office emphasizes that the accused used the social networks between March and May 2021 to contact young people with low self-esteem to “propose meetings” to them once they have gained their confidence. They took advantage of the covid pandemic situation – with confinement and mobility limitations – to hold the meetings in the apartment of one of them.
Furthermore, the defendants used a whatsapp group to select their victims. In his conversation, “they didn’t care what they were going to do with it.” Conversations were also recovered in which they spoke of sexual assaults once committed: “I would give you the phone number of someone who is very slutty and who is fine, but I don’t trust him because I see that she is capable of denouncing me.”, declared one of them.
After the proposal received on social networks, the victims agreed to attend the parties, even if the prosecution emphasizes that They were not aware of its group and sexual nature. On the other hand, they had “the knowledge and the will to attack the sexual compensation of young women, creating in the said house a climate of submission which came to diminish and even cancel the capacity of reaction of the injured people”.
The 3 sexual assaults
The five members of the Castelldefels herd They are under investigation for 3 violations. In the first case, one of the accused ended up with a disabled woman – a condition he was aware of – that he knew and summoned her to the apartment, detailed the prosecution. Once there, the rest of the group appeared. Three of them allegedly raped her in the presence of a fourth when she asked them to stop, and after the victim drank alcohol until she could no longer stand. It was April 2021.
The same accused, in May, contacted another girl via Instagram and the group acted the same way. The victim and one of the people investigated voluntarily kissed in one of the rooms of the apartment, although at no time did he give consent to have sexual relations.
When they were both in the room, two others entered. They forced one of them to perform oral sex. He did it for thepanic of suffering a major attack to his sexual freedom in the presence of the rest of the accused in the house, circumstances which led him to allow himself to be done to avoid a harm probably greater than that which he had already suffered”, indicates the tax qualification.
The third of the girls was also a victim of the May attack. To this one they recorded it and the video was shared in the WhatsApp group, as were images of another woman who were also recorded without her consent while she was having sex with one of them.
After being arrested and brought to justice before the Court of Instruction 5 of Gavà (Barcelona), the magistrate decreed their entry into temporary prisoncommunicated and without deposit. In addition to the sentence of almost 200 years in prison, the prosecution requests a compensation 50,000 euros for the first victim, 80,000 for the second and 70,000 for the third for the moral damage caused.
