Justice rejects Clavijo’s request to reactivate the “menas” protocol and admits the saturation of the islands

He Superior Court of Justice of the Canary Islands (TSJC) rejected the autonomous government’s request to lift the temporary suspension for protocol prepared by the Executive of Fernando Clavijo on the occasion of the reception of menas.

This new regulation imposed, among other requirements, that the state authorities identify each minor before being taken into care by those of the archipelago.

The prosecution appealed and the TSJC ordered its emergency suspension, considering, in harmony with the public prosecutor, that the Canary Islands protocol could be vinfringe on the rights of menas (acronym for unaccompanied foreign minors).

After the preventive suspension, the Clavijo government was able to present allegations, which were not enough to reactivate the application of these new measures.

However, in an order dated this Monday, the TSJC recognizes that “the Regional Executive does not lack reason” when it invokes the “saturation of its resources”.
