In Baku, a woman fired her husband because of a text message – CRIMINAL CASE

On January 21, 2023, Jeyhun Imashov, born in Baku in 1987, was hospitalized with serious injuries. The victim, who suffered severe head injuries, was immediately taken to the Clinical Medical Center for surgery. Thanks to the intervention of doctors, his life was saved. The Garadagh district police department was informed about the incident.

Based on the information received, police officers and the prosecutor’s office have launched an investigation. It turned out that the incident took place in a private house located in the fourth block of the Kizildash settlement. It was determined that Jeyhun was injured by his wife Lala Imashova, born in 1995.

Regarding the incident, the criminal case initiated under Article 126.1 (intentionally causing serious harm to health) of the Criminal Code was referred to the Public Prosecutor’s Office for further investigation, and the woman’s act was described in Article 29.120.1 (attempted murder) of the Criminal Code.

The investigation established that on January 21, at around five o’clock in the evening, Jeyhun Imashov saw a message from an unknown profile on Lala Imashova’s mobile phone, via the “WhatsApp” application, accusing her of betraying her. During the quarrel between them, the woman hit her husband twice on the back of the head in the living room with the sharp part of the axe she took from the hallway. Thanks to the fact that Jeyhun Imashov arrived at the hospital in time, it was possible to save his life.

Lala Imashova, questioned about the case, said that she married Jeyhun Imashov in 2011 and has three children. Her partner sometimes beat her, but in order not to separate her family, she did not contact the emergency services or the police:

On January 20, 2023, when I was going to sleep, my daughter asked me for my phone to do her computer lesson. So, my mobile phone stayed with my daughter since the night. On January 21, around 5 o’clock, my husband woke up to go to work. Jeyhun “Ali M”, who took my daughter’s phone away from him. He said that he received a message from the profile called “don’t get bored.” He asked me why that person sent that message. I told him to call Mr. Ali and ask him why, but Jeyhun did not call that person. Using insulting words, my husband grabbed my head and hit me on the ground 2 or 3 times while I was in the living room and ran to the bedroom to get a knife. I decided to stop him myself, thinking that the neighbors would not wake up. Get up and take me away.

At that moment I saw the axe in the hallway, under the stairs. I took it and went to the living room. Jeyhun was standing in front of the table. I gave the first blow to Jeyhu’s head from behind, who wanted to take a knife from the table. My husband turned around and grabbed my throat with his hand, trying to strangle me. We were holding hands. The second shot, if I’m not mistaken, hit the neck. Then the axe fell out of my hand. Then I left the house. The neighbors came to the yard after hearing the screams. After that, they took me to my brother’s house and Jeyhu to the hospital. At the time of the incident, my children woke up, but they were in the bedroom.”

Lala Imashova added that her husband threatened to kill her as she walked down the hallway towards the living room. Although they have had arguments in the past, they have never reached this point. During the incident, he himself suffered injuries to his neck, head and legs. The argument lasted for about half an hour.

The victim, Jeyhun Imashov, stated in his testimony that he works as a welder on an individual basis:

“On January 21, I woke up to go to the Hovsan settlement. Going to the living room where the children were sleeping, I took Lala’s phone from my daughter. I saw a message from the profile called “Ali M” on “WhatsApp”. I then took a photo of that message with my mobile phone.

When I went to the bedroom and asked who the message was from, Lala looked at the number and said she didn’t recognise it. I told my wife that I won’t go to work and that I will deal with this matter today. While I was sitting at the table drinking tea, I was hit on the head from behind. When he turned around, he received a second blow. After that, I called my brother Agil on my mobile phone and told him that I had lost blood and that he should come urgently. I myself called the Emergency Medical Service. Then my neighbour named Kamran came and helped me. After about 20 minutes, my brothers Agil, Ismail and Aslan arrived. The ambulance took me to the hospital.”

Ali Abbasov, who was questioned as a witness, said that since 2001 he has been working as a teacher of Azerbaijani language and literature at secondary school No. 180 located in the Kyzildash settlement:

“Since Lala Imashova’s daughter was in the fifth grade, where I taught, she would occasionally contact me to ask about her daughter’s studies. A correspondence group of teachers and parents was created on the WhatsApp program. In mid-January, the school held a “Big Summative Assessment” and depending on the results of that assessment, the students’ classes have changed. In this regard, the children thought that I would not be their teacher. On January 21, I saw a phrase written in the “WhatsApp” program, “we do not want to change classes, we miss you.” I turned off the phone typing the phrase “it’s not boring.” In February, I was called to the Garadag district police department. There was nothing between us. Parent and teacher, later I found out that the message was written by my student because she got a bad grade, she told me that she would do well in her classes in the future, not to leave them and that they would miss me. Then she got scared and deleted the message so that her parents would not know that she was studying poorly.”

Witness Kamran Khurshudov said that on the morning of January 21, his wife woke him up and told him that they could hear screams coming from outside.

“When I heard my neighbour Jeyhun Imashov screaming and calling for help, I immediately jumped over the fence into his garden. At first I thought Jeyhun had stabbed Lala with a knife. When I got closer, I saw blood coming out of my neighbour’s head and that’s why his wife’s shirt was stained with blood. So I brought iodine from home and gave him first aid.”

At the court hearing, Lala Imashova pleaded guilty to the charges. She said she defended herself and had no other choice. The victim, Jeyhun Imashov, said he would never reconcile with his wife and asked that she be punished according to the law.

The court considered Lala Imashova’s statements as statements in self-defence that do not correspond to the real circumstances of the case. Because she tried to flee from the last house after hitting Jeyhun Imashov with an axe. But she grabbed her friend’s legs and prevented him from going out into the yard and prevented neighbours from coming to the scene and helping. The woman was unable to kill the victim for reasons beyond her control.

The court considered it reasonable to classify Lala Imashova’s act under Article 29, 120.1 (attempted murder) of the Criminal Code and punish her according to law.

Lala Imashova was sentenced to 9 years in prison by the Baku Court of Serious Crimes. / cinta.az
