This Thursday, the Association of Prosecutors called for a reaction to the accusation of the State Attorney General, Álvaro García Ortiz, whose resignation it had previously requested.
The AF recalls that the entry and search of the headquarters of the State Public Prosecutor’s Office constitutes an unprecedented event which “marks a step which will take many years to be erased from our collective memory”.
The association asks the race to think, precisely because prosecutors know that an order authorizing entry and a search “is not dictated in a vacuum”. “We ask every prosecutor to meditate on how our institution appears in the procedures opened by the Supreme Court and not in the unfortunately evocative image of the police presence investigating the existence of crimes in our fundamental headquarters, but of the simple procedural presence of the Public Prosecutor’s Office.
He assures that they do not want explanations or justifications from García Ortiz as a person or as Attorney General. “We have already requested his resignation and we have already conveyed this unusual anomaly to European states, the institutions of the European Union and the Council of Europe.”
What they’re asking now is that tax professionals are looking for “difficult answers to simple questions”: “IsWhich prosecutor intervenes in the preliminary procedure? open to the Supreme Court? Who and how named it? Which prosecutor was informed yesterday of the partially known order. What perception can the instructor (or society, or the career of the prosecutor) have of the institution which must guarantee the principles of legality and impartiality when obvious reasons for abstention may arise for the person involved? Is the intervention of the deputy prosecutor of the Supreme Court imaginable when it depends directly on the person indicted and on whom its possible renewal depends? the prosecutor, like those who make up the Fiscal Council, to intervene in the criminal procedure when the Attorney General of the State himself requested their opinion from the College of Prosecutors and the Fiscal Council after having reported extra-procedurally of his version. What relationship? will the prosecutor in charge issue when asked and to whom will he report? Will we remain silent, even in conversations between us?
