Herminio Turrado, lawyer for the León City Council, obtained a judgment in his favor against the City Council for having submitted him to a overworked for nine years. From now on, and if he manages to make the sentence final, the Town Hall will have to pay him nearly 150,000 euros.
This is what the Court decided Administrative Dispute No. 3 of Leónwhich specifically set compensation of 149,858 euros for Turrado, lawyer advisor to the Administration: the judgment “demonstrates that the Administrations cannot overload to civil servants without proposing solutions to the excessive accumulation of tasks”, explained the lawyer before the General Council of Spanish Lawyers.
The sentence, underlines this organization, indicates that “the harmful situation was generated directly by the passivity of the Town Hall, which at any time could have remedied it, but did not do so”. Turrado, who represented himselfsaid they had to do the work of three people due to lack of coverage for vacant positions.
Concretely, according to the Léon’s diaryIn January 2014, the loss of a colleague reduced the council’s three-person council to two. Later, in 2020, the other colleague moved “to the situation of the special services”, specifies this newspaper, this lawyer having to take on the work of the three.
Although the lawyer claims to have alerted the situation on several occasions, his request was not heard. “The magistrates underlined the existence of a situation of intimidationin addition to the violation of fundamental rights and a lack of prevention of occupational risks, seriously affecting the health of the worker”, he declares on behalf of the Spanish Lawyers. The judgment also speaks of “reprehensible” conduct on the part of the Town Hall.
Finally, the manager criticizes the Town Hall for defending itself by alluding to the fact that it voluntarily assumed all this responsibility.
However, this sentence is not final and the Municipal Council has already appealedaccording to this Tuesday The countrybefore the Superior Court of Justice of Castilla y León.
