The president of the Central Investigating Court number 2 of the National Court, Ismael Moreno, gave impetus this Tuesday to the investigation into the Koldo affair with three orders in which he approves a battery of procedures, among which the Civil stands out. The request comes from the Anti-Corruption Prosecutor’s Office and aims to collect “the contents of all the company’s mailboxes/files between January 1, 2020 and July 1, 2020” from the former purchasing director who certified that the masks were ok although they were ok. later becoming useless, Antonio Mascaró; and the former director general of the Balearic Health Service, Julio Miguel Fuster, both senior officials in the Armengol administration who play a key role in the entire recruitment process.
They are also required to provide “all documentation in their possession regarding the contract” amounting to 3.7 million euros in masks to Management Solutions, material which subsequently became unusable. The judge also requires emails exchanged by the participants regarding the subsequent claim of the amount from the company.
In the case of the Canary Islands, “all mailboxes/folders” of the corporate email of the General Director of Economic Resources, Ana María Pérez, and all documentation relating to the purchase are also claimed. In this case, there were four files totaling more than 12 million euros in masks. They must be handed over, if they have not already done so at the request of Anti-Corruption, to UCO agents of the Civil Guard.
This is the first step in the investigation into the masks acquired by the two regional governments and which were in the hands of the European Public Prosecutor’s Office because they were partly financed by community funds. After a conflict of powers, the Supreme Court gave the National Court the power to take over the entire investigation, which until now focused on the material purchased by the Ministry of Transportation through Puertos del Estado and Adif and the Ministry of the Interior through the Secretary of State for Security.

For the judge, the overcoming of the principles of necessity, proportionality and appropriateness of a measure like this, which infringes fundamental rights, “cannot be more incontestable, because it is the only means which would allow know and identify the members of the organization. under investigation.”
“In the present case, we are not left with a simple suspicion but with the consistency and proof of clear objective indications of the participation of the persons investigated in the commission of the crimes of belonging to a criminal organization, money laundering money, corruption, against drug trafficking and against the public treasury,” he underlines.
On the other hand, the judge responds to a request from the popular prosecutor’s office made by the Liberum association and summons a battery of witnesses to try to clarify where the masks have gone, which, according to the audit of the contracts carried out by the current minister. Óscar Puente, there is no delivery certificate. There are more than seven million euros of units purchased with public funds whose final destination is unknown, on paper.

Likewise, he summons the general director of coordination and studies of the State Secretariat for Security, José Antonio Rodríguez González, better known in police circles as “Lenin” and trusted person of the Minister of Interior Fernando Grande-Marlaska. He will have to appear on October 14.
In this case, the summons is due to the fact that Daniel Belmar, former Deputy Director General of Planning of the State Secretariat for Security, declared as a witness before the National Court that it was he who indicated the name of Management Solutions as a mask supplier for this department.
