Sanchez extends complaint of prevarication against Judge Peinado for making “forced interpretations”

The President of the Government, Pedro Sanchezexpanded the complaint for prevarication against the Judge Juan Carlos Peinado in the case he is investigating against his wife, Begoña Gomezfor the crimes of influence peddling and corporate corruption.

According to published information The country on the cover this Saturday, picked up by EfeThe State Attorney General’s Office presented on Thursday, on his behalf, a document to the Civil and Criminal Chamber of the High Court of Justice of Madrid in which he requests to expand the complaint for judicial prevarication that he filed against the judge because he considers that he practices an “intrinsic injustice” and makes “forced or artificial interpretations”.

On July 30, the President of the Government, Pedro Sánchez, accepted his right not to testify against his wifeBegoña Gómez, before the judge who is investigating her for alleged influence peddling and immediately filed a complaint against the magistrate, Juan Carlos Peinado, for embezzlement.

Sánchez, in a statement that lasted two minutes at the Moncloa Palace, simply confirmed that the person being investigated is his wife and that, therefore, he has accepted his exemption from testifying against her, as permitted by law.

Shortly after, the prosecution, representing the Presidency of the Government, held by Sánchez, filed a complaint before the Civil and Criminal Chamber of the High Court of Justice of Madrid (TSJM) against Peinado for an alleged crime of judicial prevarication.

The complaint asked the TSJM to investigate the magistrate, believing that he had “knowingly” dictated several “unfair” resolutions and contrary to the provisions of the standard, since they responded to “their own convictions” which “deviate from their duty of investigation”.

The following day, the President of the Government defended the complaint for procrastination filed by the Prosecutor’s Office against Judge Peinado because the “rights” recognized by the institution of the Presidency of the Government since 1886 had been violated.

At the press conference to review the political course, Sánchez called “assembly” what happened when Peinado went to Moncloa to take his testimony as a witness and described it as “absolutely pathetic and embarrassing” to see the “extreme right-wing associations -Vox, Manos Cleans and Hazte Oír- fighting” to see who could access the Palace.

Three days after this complaint, Begoña Gómez, wife of the President of the Government, also filed a complaint for alleged prevarication against the investigating judge in her case, considering that adopted “arbitrary and manifestly unjust” decisions and “forced” the rules to make it a “perverse” instruction.

Gómez’s lawyer, the former minister Antonio Camachorequested the High Court of Justice of Madrid to investigate the magistrate for alleged crimes of prevarication, disclosure of procedural acts declared secret and disclosure of secrets by a public official.

On August 22, Judge Juan Carlos Peinado said in an order “Conclusions” can be drawn from “silence” de Sánchez when he refused to testify before him in Moncloa.

He said his “silence” was “legitimate” but that, “as we know, allows the formation of inferenceswhich, where appropriate, together with other elements of an objective nature, may lead to conclusions of an objective nature, in order to assess the possible concordance of constituent aspects, of possible clues, either in an incriminating sense with regard to a person who is the subject of an investigation, or, therefore, “on the contrary, in the exclusive sense of criminal responsibility”.
