The prosecution appeals the summons of Pedro Sánchez’s brother to the Badajoz court

The Badajoz Provincial Prosecutor’s Office appealed the order of Judge Beatriz Biedma who requests that David Sánchez Pérez-Castejón, brother of the president of the government, be declared under investigation next January; and nine other people, including current and former senior officials of the Provincial Council, because it considers that neither the facts attributed to them nor the behavior attributed to them have been sufficiently identified to complete this stage of the investigation.

“In this case, nor by reference to other previous actions, there is no behavior of a criminal nature for each of the persons investigated, which we consider essential for their defense and it is this omission which, in our opinion opinion, must be resolved. “. before the dissemination of the statements”, affirms the public prosecutor, who requests the repeal of the order by which the persons investigated, as well as a group of witnesses and experts, were summoned between the 8th and the 10th January.

According to the reasoning, the order “is limited to accepting these declarations of the persons questioned to ‘guarantee the full effectiveness of the right of defense and prevent material situations of helplessness from arising against them, even during the investigation phase ‘”.

“However, this judicial resolution does not present any existing evidence against each of the persons whose statements are intended to be taken in the investigation; The specific crimes each of them is being investigated for are not even stated. The generic reference made to “crimes against the public administration under investigation” cannot satisfactorily fulfill the right of defense,” he asserts.

A few days ago, the judge adopted the decision to summon the brother of Pedro Sánchez and the president of the Provincial Delegation of Badajoz and leader of the Socialists of Extremadura, Miguel Gallardo, as well as several officials of this organization after a report of the UCO which concluded that the position of senior public management that David Sánchez would later occupy as head of the performing arts department of this organization was conceived within a period of three days, when this administration was went from being understaffed to over-covering every vacant position it needed. to urgently demand to fill this newly created position with content.

However, the agents, who had analyzed the email accounts of a dozen Provincial Council officials, did not find the origin of the order. The report specifically stated that it had not been determined who took the initiative to create this job.
