The Juvenile Court number 4 of Valencia imposed 24 months of imprisonment on the minor who extorted the creator François Montesinos with a sex video in October 2022, according to the judgment to which Europa Press had access.
On September 26, a trial was to take place in Valencia against this minor and another teenager involved in the events but, before the hearing, an agreement was reached between the accusers and the defense in which they admitted the facts and their sentences were reduced.
In this way, the court imposed 24 months of semi-open confinementdivided into 18 months of effective detention and six months of supervised release, to the minor who extorted Montesinos for three continuous crimes of threats; a crime of trespass; a crime against privacy; a crime of theft with violence; and two minor injury offenses.
The other minor who participated in the blackmail plot was sentenced to seven months of probation for the continuing offense of threatening. In civil liability, the first minor must compensate Montesinos with 5,000 euros plus legal interest.
The facts date back to September 2, 2022, when one of the convicted minors I have Montesinos’ cell phone -represented in the proceedings by the Castillo Castrillón Zapata law firm- through an adult and began sending him messages on WhatsApp in which she told him that she knew him by sight because he often passed by the door to his studio, which was very beautiful and I loved it.
He told him he was 18 and repeatedly expressed his desire to meet him. He gained Montesinos’ trust until he invited him to his home located in Llíria. The minor came to the house on at least September 5 under the pretext of helping him move and the next day they ate together. They then went up to the room where they had sexual contact recorded by the minor without the consent or knowledge of the designer.

Once the minor got what he wanted, around 8:30 p.m. the same day, with another adult, they sent him videos of the sexual relationship to his cell phone and asked him to pay one million euros for not realize them. public. Montesinos saw the messages the next day and told them he was going to report it to the police. The minor then told him to pack his bags to go to prison because it was a 15 year old boy and “you mistreated me,” he said.
From that moment, and since the designer did not comply with his requests, they sent him audios and messages in which they told him, among other things, that they were going to publish the video on social networks and that They were going to report to the police station for abuse and rape. They also told him that they had contacted the collaborators of a television show.
In the absence of answers, on September 25, the minor entered Montesinos’ home, taking advantage of the fact that the door was open, went to his room, woke him up and told him that “he was coming to settle the issue”. The designer told him that he had no money and that the minor had left the premises when the automatic lights in the garden had turned on and out of fear that someone would arrive.
By not accepting his requests, the minor planned, together with the adult, to teach Montesinos a lesson, and they provided two people with the designer’s information so that they could access his home, which they made on October 2. They entered with their faces covered and They attacked him with a stick to the head and shoulder then secure it with zip ties.
Then they started stirring up the room, telling him “the gold, where is the gold”, and later they asked him for 500,000 euros not to broadcast the video because otherwise they were going to kill him. However, they heard a woman screaming and fled the scene without achieving their objective.
It is precisely in connection with these events that Montesinos was acquitted of the charge of alleged sexual abuse of a minor, because proof of a crime was not proven by the procedures carried out.
