Jamal was accused by the investigative body of article 152.1 of the Penal Code (having sexual relations with a person who has turned fourteen but has not turned sixteen or performing other acts of a sexual nature).
Jamal, who testified as a defendant in the criminal case, pleaded guilty to the charge announced to him. He said that he has known the victim Asmar since 2023: “I saw Asmar with her friend for the first time while walking in the Bulvar area in Sumgayit city. I know Asmar is 14 years old. However, I intended to get married because I was serious about him. We agreed to wait until Asmar turned 16 or 17 and then get married. “I told my parents.”

According to Jamal, Asmar turned 14 on October 29, 2023: “For Asmar’s birthday, I received a cake and a silver sepal with a clown with the number “13” written on it. Then, together with Asmar and his mother, Khatira , She celebrated her birthday in one of the restaurants located on the boulevard. Until that moment she had not had sexual relations with Asmar.
In mid to late November 2023, we met with Asmar in the afternoon and together we bought his house. To help, I brought the things he bought to his apartment.
Asmar invited me in because his mother was not at home. As she spoke, I couldn’t help it, I kissed her. He kissed me too. We both got excited. We went to the bedroom, got naked and I had sex with her for the first time with her consent. As a result of the relationship, Asmar’s virginity was violated. He said he won’t tell his mother about this.
After that, we had sex 3 or 4 more times in that apartment on separate dates until mid-December. “I know that Asmar is 14 years old and not yet 16. Despite this, I did not own my passion and I had sexual relations with Asmar at her suggestion.”
According to Asmar, who testified as a victim in the case, although he was a seventh grade student in the city of Sumgayit, after finishing the sixth grade, he refused to go to school starting from the new academic year on his own initiative:
“On July 13, 2023, while I was walking along Sumgayit Boulevard with my girlfriend, a young man I didn’t know, who introduced himself as Jamal, approached me and said he wanted to meet. At first glance, I realized that I liked Jamal, so I didn’t oppose him.
After that, we started meeting with him regularly and talking on the phone. About two months later, I introduced Jamal to my mother.”
The victim noted that on October 29, he celebrated his 14th birthday together with his mother Khatira at one of the restaurants located on the boulevard of Sumgayit City, and Jamal also attended that birthday.
“Jamal gave me a cake and a silver necklace with the number ’13’ on it, which is the date we met. A week or two after my birthday, that is, in mid-November, we went shopping with Jamal at the nearby market. Afterwards, Jamal bought a store. When I got home, I invited Jamal to my apartment and kissed him. After that, we both went to the bedroom with my consent and I realized that My virginity was broken.
According to Asmar’s testimony, Jamal later left his house: “I didn’t say anything to my mother about having sex with Jamal. After that, I had sex with Jamal 3 more times in the apartment where he lived at different times. The last time we had such a meeting was on December 15, 2023. What happened?
On the morning of January 8, 2024, while I was at home with my mother, I told her that I had had sex with Jamal several times. My mother got angry and went to the 4th Police Department of Sumgayit City and wrote a complaint. Jamal never used force during sex with me. Every time I had sexual relations with my own will and consent.”
According to Khatira, the mother of the victim Asmar, who was questioned as a legal representative in the case, in October 2023, her daughter Asmar told her that she met a boy named Jamal and that they loved each other:
“He also introduced me to Jamal and we developed a friendly relationship. We even celebrated my daughter Asmar’s birthday at a restaurant with Jamal. Sometimes Jamal himself and other times Jamal’s mother would come to visit us, and after Asmar’s 18th birthday , they got married. According to tradition, we have agreed to get married.
On January 8 of this year, while speaking at home, Asmar claimed that she had an intimate relationship with Jamal in mid-November 2023 and that Jamal violated her virginity. When I heard this news, my condition worsened. I immediately called the 102 service of the Ministry of the Interior and reported it. I was invited to the 4th Police Department of the Sumgayit City Police Department. I filed a complaint about the incident.
Currently, Jamal and his family members have promised me that they will marry my daughter when she reaches the legal marriageable age, and we have engaged them according to custom. Therefore, I have no complaints about Jamal. We have come to terms with it now. In the future, we are planning to marry Jamal and my daughter.”
This criminal case was heard in the Sumgayit municipal court. According to the court’s verdict, Article 70 (conditional sentence) of the Penal Code was applied to Jamal. He was given a 1-year suspended sentence with a 1-year probationary period.
