Ayuso’s new “star” law will make it possible to transform offices into 7,500 rent-protected homes in the Madrid capital

Madrid City Hall will apply Isabel Díaz Ayuso’s “star” law to transform offices into housing with cheap rents. This summer, the regional government approved a mechanism to quickly transform the use of tertiary land – intended for offices – into residential land. The Community has given municipalities four months to decide whether or not they wish to apply it.

After a study, the City Council of José Luis Martínez-Almeida calculated that the initiative would allow the construction of certain 7,464 housing units with protected income in capital, half in Hortaleza. And this, only in a first phase.

The delegate for Urban Planning, Environment and Mobility, Borja Carabante, will report on this analysis to the Government Council this Thursday. The estimated figure – indicates sources in the Zone – could increase to 20,000 houses as work progresses on new developments in the capital. The application of this law in the city will be brought to the plenary session in October.

The Regional Executive has launched the decision to free up 1.8 million m2 of premises with the aim of transforming them into 20,000 new homes throughout the regional territory. The measure, which is temporary, is known administratively as “Law 3/2024, of June 28, relating to urban planning measures for the promotion of sheltered housing”. And this allows, in summary, to change land use via a license and not via the special plan figure.

When the text of the preliminary draft was made public, no one presented as many allegations as the Madrid City Council. Actually, Cibeles managed to make changes in 43.75% of articlesas reported in this newspaper.

Díaz Ayuso’s regulations are made up of only two articles. The first serves to rationalize bureaucracy and the second develops the particular regime of land use change. What the Urban Planning Zone has done is to study the application of this last point in the Spanish capital.

Firstly, the City Hall analyzed which areas of the city were located in which, due to the classification of land (“tertiary offices”), Law 3/2024 would potentially be applicable. It includes plots with express qualification for tertiary office use, whether exclusive or concurrent with other qualified uses.

To obtain the data, we took into account the state of urbanization of areas and degree of construction plots with a view to their possible transformation.

They were excluding, however, areas for industrial use as they are not considered suitable for housing development.

Thus, thanks to the system proposed by the region, the capital estimates that some 7,464 rental housing units could be set up. subject to a certain public protection (VPP). By neighborhood, the one with the most potential is Vegetable (3.725), followed by Vicalvaro (2,092) and Vallecas Villa (1,032).
