STATEMENT of the Prosecutor General’s Office about Ahmed, who killed his relatives: “Serious treatment was prescribed”

“According to the final decision of the court, Ahmet Mehman oglu Ahmadova, who suffers from a mental disorder, was prescribed the most serious type of compulsory medical measures prescribed for persons with a mental disorder defined in Article 95 of the Criminal Code: compulsory treatment under intensive observation in specialized psychiatric patients.”

The “Report” reports that Orkhan Samadov, prosecutor of the Department of Defense of the State Prosecutor’s Office in the Serious Crime Courts of the Prosecutor General’s Office, stated this in a statement to journalists.

He noted that the trial on the application of compulsory medical measures against Ahmed Mehman oghlu Ahmadov was held in the Baku Serious Crimes Court, who committed the crime provided for in the criminal code of the Republic of Azerbaijan in an unreasonable situation, provided for in article 120.2. 4, 120.2.7 and 120.2.9 Ended October 10, 2024:

“According to the court hearing, under the influence of a mental illness diagnosed with a paranoid form of schizophrenia, paranoid-hallucinatory syndrome, his father Mehman Ahmet oglu Ahmadov, his sister Elmira Mehman gizi Ahmadova, the latter’s youngest daughter, born in 2021 , were In a state of unconsciousness it was established that he deliberately killed Ulviyya Sarkhan gizi Niftaliyeva, her mother Pike Badal gizi Ahmadova and her brother Mahammad Mehman oghlu Ahmadov, born in 2015, with special cruelty.

During the preliminary investigation of the criminal case, two forensic psychiatric examinations were carried out and, according to the opinion of both experts, Ahmadov Ahmet Mehman oglu suffered from a mental illness of the type “schizophrenia in paranoid form, hallucinatory-paranoid syndrome manifested by an acute psychotic state “when he committed the crime for which he was accused. It was determined that he was incapable of understanding the true nature and social danger of his actions and of controlling them. At the same time, due to his current mental state, AM Ahmadova was prescribed mandatory inpatient treatment, taking into account that it is dangerous for himself and others.

According to Article 21 of the Criminal Code, when he committed a socially dangerous act, he was in an irrational state, that is, he did not understand the real nature of his act (action or inaction) and the public danger as a result of a chronic illness. mental illness, temporary impairment of mental activity, mental retardation or other mental illness, and/or the person who cannot control it is not criminally responsible. Furthermore, according to this article, the court may apply mandatory medical measures provided for in this code to a person who has committed a socially dangerous act in an unreasonable situation.

According to the court’s decision, the release of Ahmad Mehman oglu Ahmadov from criminal liability and punishment does not mean his release at all. According to the court’s decision, Ahmad Ahmadov will be admitted to an appropriate specialized psychiatric hospital for mandatory treatment under intensive observation.

At the same time, I would like to note that in cases provided for by legislation, a day of compulsory treatment in specialized psychiatric patients is counted as a day of deprivation of liberty.
