Prosecutor’s Office rejects Begoña Gómez’s complaint against Judge Peinado for prevarication

The prosecution asked the Madrid Superior Court to dismiss the complaint filed by Begoña Gómez and her lawyer against judge Juan Carlos Peinado for prevarication. The Public Ministry, which maintains its support for the complaint filed by Pedro Sánchez against the magistrate through the Public Ministry, understands that many of Gómez’s complaints must be resolved through the resources he presented and recalls that in the case of the testimony of the President of the Government, he appreciated that Peinado could act according to “purposes unrelated to the proper exercise of the judicial function”.

For the prosecution, many of the accusations against Gómez are the subject of the appeals he has presented in recent months. Regarding the assessment that Peinado seeks “political and social impact” or that he has “an excessive desire for a leading role”, the Madrid Public Prosecutor’s Office understands that these are “mere subjective assessments of one party interested without concrete factual support”,

The Madrid court received three complaints against Judge Peinado for the management of the procedure in which he is investigating, at the request of Manos Médicas, the wife of the president of government. One of them was presented by the journalist Máximo Pradera, rejected a few days ago by the judges with the support of the prosecution, rejecting his accusation of revealing secrets against the judge for making statements about the case while she was under summary secrecy.

The other two complaints were filed by Pedro Sánchez and Begoña Gómez and are still awaiting a response from the judges. In the case of the one filed by the Prosecutor’s Office on behalf of the President of the Government, the Prosecutor’s Office supported the opening of a case against Peinado for prevarication, knowing that he could have committed a crime by summoning Sánchez as a witness in person. in his office in La Moncloa even though the law allowed this to be done in writing.

Regarding the complaint filed by Begoña Gómez’s lawyer, the opinion of the prosecutor Almudena Lastra is contrary and, after regretting not having been able to examine the entire file, she requests its inadmissibility. In this case, the Public Prosecutor understands, the arguments and differences raised by the businesswoman in her complaint can be resolved through appeals both before the court itself and before the Provincial Court of Madrid, which has recently given the green light to move forward with the process. complaint against her but limiting the scope of the procedure.

“It has been verified that the resources have been attached to the actions, they have been provided and some have been resolved or are in progress”, affirms the prosecution, emphasizing Peinado’s slowness in handling these complaints but concluding that, at least for At the moment, in the case of Gómez, we cannot speak of a crime of prevarication.

The Court approves the case

In recent weeks, Judge Juan Carlos Peinado received approval from the Madrid Provincial Court to continue the trial against Begoña Gómez, but asking him once again to stop investigating issues such as her involvement in the rescue of Air Europa, which cost a million dollars, a case for which there is no more evidence than the press articles provided by Manos Liminas when filing the complaint. The judges only partially upheld the appeals of Gómez and the prosecution and rejected the main request to archive the entire procedure.

The court in charge of the case understood that the investigation should continue to focus on Gómez’s relationship with businessman Juan Carlos Barrabés and the possible advantage he obtained in obtaining public contracts. So far, the Central Operational Unit (UCO) of the Civil Guard has rejected any irregularity in these contracts and Barrabés himself has denied it in his two statements.

Another part of the proceedings that Peinado is leading from court number 41 in the capital revolves around Begoña Gómez’s relations with the Complutense University of Madrid, which recently canceled the two master’s courses she was leading. The rector of the center, Joaquín Goyache, appeared as a witness and as an accused and in both appearances he denied any favorable treatment to the wife of the president of the government, recognizing that he visited La Moncloa on several occasions to meet her.
