García Ortiz, the first attorney general indicted, will inform his leaders that he continues, without allowing a vote

The Attorney General, Álvaro García Ortiz, will not be put to a vote today by House attorneys or the Fiscal Council his decision to remain in office after the Criminal Chamber of the Supreme Court decided to investigate him for the alleged revelation of confidential data about the friend of the President of the Community of Madrid, Isabel Díaz Ayuso.

The appeal of the tax career management and its elected officials “this is not a plebiscite”say sources from the Attorney General’s Office, who emphasize that the decision not to resign is the exclusive responsibility of García Ortiz and is “firm.”

The Attorney General, who received the “full support” of the government through the Minister of Justice, Félix Bolaños, will meet from 9:30 a.m. the College of Chamber Prosecutors, the supreme body of the prosecution in doctrinal matters. and technical questions.

Some of its members criticized the fact that García Ortiz called them after publicly announcing that he would remain in office and not before. But sources from the General Prosecutor’s Office explain that it is a question of “informing” and “reporting” to the College of Chamber Prosecutors of the reasons for his decision to remain in office, not to adopt agreements or for this body to pronounce on a personal and personal power of the head of the Public Prosecutor’s Office which, according to the statute, must not be consulted nor, even less, voted on.

Several members of the College of Prosecutors believe that García Ortiz should resign. But many others support his retention in power for at least three reasons: his performance in this area “has been legal and transparent“, the alleged crime that is the subject of the case has always been difficult to prove and “cannot give this victory to those who seek his head.”

But other prosecutors of the Chamber consider that, whatever the future of the criminal case and even in the event that it ends up being archived, the permanence of Álvaro García Ortiz at the head of the Public Ministry is “ abnormal” and “unusual”.

“He is the first prosecutor of democracy to whom a chamber of five judges of the Supreme Court decides, unanimously, open an investigation by appreciating the signs of crime. The Attorney General cannot continue as if nothing had happened,” they emphasize.

Others believe that, “without calling into question his actions”, his procedural status as investigator constitutes “a discredit for the institution” and “damages the credibility and image of the entire prosecution and of its members”.

“He has to go because What is at stake is the prestige of the institution, which is above him“, says another prosecutor from Sala. “The Attorney General represents an institution that ensures compliance with the law; anyone who is investigated for violating it cannot remain in charge,” he adds.

In the afternoon, García Ortiz will chair the Fiscal Council, the democratic representative body of the race. The intention is the same: that the meeting is limited to information on the decision not to resign from office.

However, in this body the members of the Association of Prosecutors are in the majority, who yesterday requested the resignation of García Ortiz.

It is predictable that the AF advisors will want to reiterate to the Attorney General the position of the majority association and make García Ortiz understand that the race is shaken (“in shock”say Council sources), due to the Supreme Court resolution which grants the status of educated person to the head of the institution.
