To satisfy his sexual desire naturally and unnaturally, he entered the room where Lama was. He intimidated her and took advantage of her helplessness, had unnatural sexual relations with her and subjected her to other acts of sexual violence.
Continuing his criminal intent, Murad attempted to have sexual relations with Laman by force. After the familiar entered the room, Murad was unable to carry out his intention to the end.
Murad was charged by the investigative body with articles 29.149.3.3 (attempted rape of a person under fourteen years of age) and 150.3.3 (commission of acts of sexual violence against a person under fourteen years of age) of the Penal Code.
Murad, who testified as a defendant in court, pleaded not guilty to the charges announced against him. He said that he did not have sexual relations with Laman, that he did not touch him, that he signed the statements written by the police because he was afraid of them. He asked the court to make a fair decision about him.
Since there are significant contradictions between the defendant’s statements previously and the statements he made during the trial, his statement was announced during the investigation.
Murad, who testified during the preliminary investigation, pleaded guilty to the charges against him. He stated in his statement that on November 29, 2021, at around 12 noon, he had sexual intercourse with his aunt Naila’s daughter, Laman, on the carpet of the television room in the village of Saatli district, naturally. and not medical. shape:
“When I had sex with Laman, I did not force him. I had sex with him of his own free will. Laman did not resist at the time of the incident. Furthermore, I did not hurt Laman in any way. Everything Laman said in his statement that having been raped by me is a lie, so nothing happened.”

This criminal case was heard in the Lankaran Serious Crimes Court. According to the court verdict, Murad was sentenced to 9 years and 6 months in prison. It was determined that he will serve his sentence in a general education institution.
Dissatisfied with the verdict, the defendant’s defense attorney filed an appeal. The lawyer justified his complaint in such a way that, according to the evidence examined during the judicial investigation, the accusation against Murad cannot be considered proven. The defender requested acquittal on both charges.
The legal representative of the victim Laman also filed a complaint. She justified her complaint by saying that the accused Murad did not commit any violent act against her daughter: “My daughter is lying, there was no such incident. My daughter herself admitted that Murad did not commit any indecent act against her. He did not do it. I understand that the matter would come at this level “However, after Murad was taken away in handcuffs, he confessed to me. I sent a notarial request to the court of appeals at the first opportunity.”
According to the decision of the Shirvan Appellate Court, the complaint filed by both the defense lawyer of the accused and the legal representative of the victim was not satisfied.
Dissatisfied with this decision, the defendant’s defense attorney filed an appeal. He asked for his client’s acquittal.
The legal representative of the victim Laman also filed an appeal. He stated in his complaint that he had no complaints against Murad and told the appeal court: “But the appeal court did not accept the application because there was no word of reconciliation in the application. I have no civil claims or complaints against him.” in the future. My daughter. After the truth he told me, I reconciled with Murad and there is no conflict between us.”
The parties’ appeal was considered in the Supreme Court. The panel of judges investigating the allegations made the final decision. According to the decision, the complaint of both the defendant’s defense attorney and the victim’s legal representative was not satisfied.
