A man who refused to dress after going naked to a Valencia police station to file a complaint is sentenced

The Criminal Chamber of the Supreme Court confirmed the conviction of a fine of 1,080 euros for the offense of disobedience inflicted on a man who refused to dress after presenting himself naked to the Valencia police station to file a complaint.

The events occurred at nine a.m. on August 20, 2020, when the now convicted, Alexandre Colomara young Valencian naturist very popular in the city, He went to the Valencia Maritime District Police Station, completely naked, to file a complaint against a person even though he had clothes to wear in a backpack.

On several occasions, officers asked him to dress because he was in a public place with other citizens and disrupting the normal operation of the office.

Despite multiple warnings about the legal consequences of his behavior, “clearly and categorically refused” to get dressed, saying he had the right to be naked, so he was arrested.

The court considers that the order issued by the agents was legitimate and affirms that their behavior “was necessary for the maintenance of public order and peaceful coexistence, and that at all times it was in conformity with the fundamental principles and criteria of “action, as the fundamental axes around which the development of police functions revolves”.

The resolution, consulted by EL ESPAÑOL, indicates that, in this case, regardless of whether or not nudism is prohibited in the city of Valencia, the police intervened after being alerted by the security agents that the accused was wearing fifteen minutes in the complaints waiting room, naked and with boots.

Remember that, as indicated in the judgment of the court of first instance, an agent of the National Police declared that there were colleagues at the police station who did not want to see him and that with two other people they had left the premises, so that the office was paralyzed.

“Thus, the presence of the appellant, naked, in the waiting room of the police station, had already provoked reactions from those present and from certain female officers, who changed the order in the office” , he emphasizes. bedroom.

In the same spirit, “as the proven fact describes, The police asked him several times to get dressed.given that it was a public place with more citizens and that this disrupted the normal functioning of the office”, underlines the Court.

In this sense, he adds that, as the criminal judge rightly says, “we must not forget that the aforementioned agencies are not only a place of constant flow of citizens of all ideologies, beliefs, ages and practices that require the action of law enforcement, but also the place in which members of the State security forces and bodies carry out their professional work (with the respect and dignity that every worker deserves)”.

Therefore, “the imposition by the accused of his naked body exceeds, (…), which can be understood as an exercise of his philosophy of life, quite respectable though“.

For this reason, the Chamber rejects the appeal filed by the convicted person against the sentence of the Provincial Court of Valencia which confirmed the sentence of six months fine with daily rate of 6 euros (1080 euros) that a criminal court in the same city had imposed on him for the offense of disobedience.

In his appeal, the accused argued that his fundamental right to ideological freedom and expression had been violated.
