An appeal was filed against the sentences handed down against former officials of the Ministry of the Interior

An appeal has been filed against the verdicts of Mahir Shirvanov and Malikmammad Gurbanov, former heads of departments at the Ministry of Defence (MoD), who were arrested on charges of embezzlement.

Oku.Az reports that this was reported by the Press Service of the Attorney General’s Office.

It was reported that information about the lower sentence imposed by the Baku Military Court on Mahir Maharram oglu Shirvanov and Malikmammad Oruj oglu Gurbanov was spread on some social media pages:

“Mahir Shirvanov and Malikmammad Gurbanov were charged with Article 179.4 (embezzlement by causing large damage) of the Criminal Code, as reasonable suspicions were established that they entered into criminal relations with other persons and embezzled a large amount of state property while working as head of the Procurement and Supply Department of the Ministry of Defense and the preliminary investigation into criminal cases was completed and sent to the relevant Military Court in Baku for consideration.

It was noted that by the verdicts of the Baku Military Court dated 9 September 2024, Mahir Shirvanov and Malikmammad Gurbanov were found guilty of committing the act provided for in Article 179.4 of the Criminal Code and were sentenced to a term less than that stipulated in the sanction of the article – Mahir Shirvanov 3 years for the sentence, Malikmammad Gurbanov was sentenced to 4 years in prison.

“Given the nature and public danger of the defendants’ actions, as well as the incorrect application of criminal law norms and the imposition of a sentence below the limit provided for by law, the State Prosecutor filed an appeal against the above-mentioned sentences on September 24,” the report says.
