The Argentine justice ratified this Wednesday the conviction of the Peronist Cristina Fernández de Kirchner by the one known as cause of the road. The resolution provides for a 6-year prison sentence and perpetual disqualification for the former Argentine president for corruption. The sentence, handed down at the end of 2022, was ratified by the Federal Chamber of Criminal Cassation.
Thus, the magistrates conclude that Cristina Fernández de Kirchner is guilty of a crime of fraudulent administration to the detriment of public administration. They therefore coincide with the decision of the first trial.
The former Argentine president was facing legal action, accused of participating in a plot to defraud the state through public works concession in the province of Santa Cruz. She did so during her mandate (2007-2015) and during that of her husband Nestor Kirchner (2003-2007), died in 2010 at the age of 60 due to the progressive deterioration of his health.
The prosecution, which had requested 12 years in prison against the former president, estimated 5.231 million pesos (more than 39 million euros) the amount is disappointing due to the network which also includes Néstor Kirchner and former officials like the former minister Jules Vido. However, the Peronist did not go to prison when she began an appeal process. On the other hand, Cristina Fernández de Kirchner was acquitted of the offense of association with a view to committing a crime.
“Political persecution”
The former president denounced having been the victim of political persecution of the judicial field. After this ratification, Cristina Fernández de Kirchner still has the possibility of presenting a last appeal, in this case before Supreme.
Likewise, the Court of Cassation also confirmed the sentences of the rest of the defendants, with six years in prison for the businessman. Lázaro Báezwho is under house arrest. His company, Austral Construcciones, received the fifty projects that were investigated in this case.
Last October, even knowing the sentence, Cristina Fernández de Kirchner announced her intention to lead the Justicialist Party, the historic formation of Peronism that ruined the country. He therefore does not give up on returning to power.
