Brussels approves Spanish veto on acquisition of Talgo by Hungarian group Ganz-MaVag

This Thursday, the European Commission ratified the Spanish government veto to the operation launched by the Hungarian company Ganz-MaVag (Magyar Vagon) to buy Talgo, claiming that it protects the interests and “national security”, stressing that the situation could end currently being settled before the Court of Justice of the EU.

At a press conference in Brussels, Community spokeswoman Francesca Dalboni avoided raising objections to the government’s move after assuring that it was the prerogative of member states to adopt these types of decisions.

He therefore recalled that the EU treaties allow restricting the freedoms of the single market, such as freedom of establishment and the free movement of capital, citing reasons of public security.

“The measures must be justified and proportionate to the objective they pursue,” added Dalboni, who indicated that the Spanish authorities had no obligation to inform the European executive in advance of their decision.

After ethe potential buyer, Magyar Vagon announced that it would contact the European authorities to denounce the Spanish manoeuvre, the European Commission assured that it had not yet heard from the company.

In this sense, the spokesperson of the community, Eric Mamer, summed up that the principles according to which the EU operates appear to be included in the treaties and such decisions must ultimately be overseen by the CJEU.
