Brussels opens new case against Spain for abuse of temporary workers

The European Commission opens a case against Spain for abuse of temporary workers in the public sector. Brussels took the first step in the infringement procedure by sending a letter of summons to the government in which it criticizes the fact that Spanish legislation does not provide protection measures for temporary workers in the public sector who follow contracts in accordance with what European regulations establish. .

Brussels recalls that EU rules oblige member states to take measures “to prevent and, if necessary, punish abuses through successive fixed-term employment contracts”. “The Commission confirms that Spanish legislation does not provide for such measures for certain types of fixed-term employment relationships in the public sector,” it says in a press release in which it cites, for example, that temporary workers who have had consecutive contracts for 20 or 30 years have the same compensation or that, in the case where they leave the position voluntarily or for care, they are not even entitled to it.

The procedure is in addition to the one that the European Commission opened in 2015 when the community executive understood that the changes made by Spain since then were not enough to comply with the standards established by European regulations.

Temporary workers are fighting an uphill battle in the EU over the violation of their rights. Recently, the Court of Justice of the EU approved that long-term temporary workers become permanent without being considered civil servants in an attempt to limit the abusive position of the administration and reprimanded Spain for not considering sanctions to punish abuses.
