Campo’s abstention accepted

The plenary session of the Constitutional Court gave the starting signal for one of the most delicate debates in its history, that which concerns the constitutionality or not of the amnesty law and its application to those responsible for the attempted secession of Catalonia carried out in the autumn of 2017.

The TC has admitted to address the question of unconstitutionality in which the Criminal Chamber of the Supreme Court maintains that the amnesty of the ‘trial’ violates equality before the law and the principles of legal certainty and the prohibition of arbitrariness of public powers.

The court unanimously accepted the abstention presented by Juan Carlos Campo, who, as Minister of Justice, declared that the amnesty granted to those convicted in the Catalan sovereignty process was “clearly unconstitutional.”
