This Tuesday, we learned of the partial cancellation by the High Court of Justice of Madrid (TSJM) of the 2021 order of Madrid City Hall on low emission zones. More specifically, they refer to the entire area of those known as ZBE of the municipalityalso including that of the Centro district and the Plaza Elíptica.
This may be disconcerting for Madrid residents who are used to not being able to enter with cars without environmental label in these areas. Some were forced to buy a new vehicle that complies with the regulations. The question is whether they will be able to enter these days with a car without a label after the TSJM decision without being fined.
The answer is no, because this decision does not mean that the capital’s ZBEs automatically decrease. And that’s it the resolution is not firm. Any cancellation would occur later, so the sanctions remain in force in the event of non-compliance.
The city council has 30 days to call in cassation before the Third Chamber of the Supreme Court, which has jurisdiction over matters of this nature. Only if the TSJM ratifies the sentence will an enforcement file be opened to annul these areas.
Sources of Area of Urban Planning, Environment and Mobility explained that their legal services had not yet studied the sentence, as reported Madrid Total in a previous news.
Therefore, at that time, The entire city of Madrid is declared a low-emission zone. This means that no vehicle without an environmental label – diesel registered before 2006 or petrol before 2000 – can circulate in the capital.
The geographical scope of the restriction has been gradually extended to the entire city, with the project launched by the current mayor of the capital, José Luis Martinez-Almeida, Madrid 360.
Fines of 200 euros
The ban was imposed in January this year and came with a notice period until June. From that date, the economic sanctions of up to 200 euros.
The tool is under the aegis of Ordinance on sustainable mobility and seeks to improve the air quality of Madrid. For this reason, the ZBE prohibits the passage of vehicles with environmental classification A – or cars without a label – in the register of the General Directorate of Traffic (DGT).
They will only be able to move within the municipal area of Madrid. using the M-40, M-45 and M-50 roads, as well as radial motorways up to the M-40 limit. This set of roads is free of restrictions. Everything within these circular highways and part of the capital is now prohibited for these vehicles, including the M-30.
There is exceptions to this rule and among them are the registered in Madrid before January 1, 2022 and those who transport people with reduced mobilityIn the latter case, private cars must have the regulatory parking card and be registered in the “Madrid Low Emission Zone Access Management System”.
Likewise, until the end of this year, those who do not own a private car will be able to visit the capital. That is, trucks, vans, motorcycles and mopeds. Another exception is the historic classified cars.
