Complaint against Colau for alleged coercion to prevent eviction filed

The president of the Court of Instruction 20 of Barcelona, ​​Judge Eva Molto, accepted the provisional dismissal of the complaint filed by the real estate company Juninmo against the former mayor of Barcelona, ​​Ada Colau, for alleged coercion aimed at preventing the eviction of ‘a vulnerable tenant.

Junimno accused Barcelona City Hall of having “coerced the real estate company and demanded 100,000 euros in compensation for the damage”, as Barcelona en Comú explains in a press release, an extreme of which there is no proof, now says the magistrate.

In the document put forward by ‘Eldiario.es’ and consulted by Europa Press, the judge maintains that after ordering the expulsion of a resident of Barcelona, ​​he claimed to have no income or alternative housing, ‘where the postponement of the launch was accepted and the situation was reported to social services.

The magistrate adds that the town hall has opened a case against this real estate agency for violation of “law 24/215, which obliges large property owners to grant social rent to tenants without housing alternatives and who risk social exclusion”. which respects the consistory procedure in these cases.

Concerning the second file initiated, for the authorization of a property for use as a tourist apartment without having the corresponding permits, an error occurred in the identification of the property, “so it would be particularly complicated to speak of reprisals against the complainant”. for part of the Colau Executive, according to the owner.

The judge maintains that neither the former housing councilor, Lucía Martín, nor the mediator nor the three municipal officials who intervened in the opening and processing of the aforementioned files committed “any criminal offense” and that he there is no evidence that they used coercion. or procrastination, because there is therefore not enough evidence to justify continuing the investigation phase.

With this, “there are now 19 complaints filed against Mayor Colau and her government team in what Barcelona en Comú considers an unprecedented legal war against the municipal government”, they affirm from the training.

“The legal war that our government team has suffered from lobbies who do not want to adhere to legitimate policies of defense of the social majority has served to make noise, to attack the image and the honorability of democratic representatives and to influence public opinion regarding the elections. process,” they add.

Furthermore, also this Monday, the Criminal Chamber of the Supreme Court (TS) rejected the appeal presented by the former chief architect of Barcelona City Hall, Josep Anton Acebillo, who had filed a complaint in 2023 against the former mayor from Barcelona. ​Ada Colau, and against the former deputy mayor and head of town planning, Janet Sanz, for the construction of the Eixample “superblock” for alleged town planning offenses and misappropriation of funds in green axis projects.

In the order consulted by Ep, the TS recalls that the Barcelona Provincial Court has already filed the case and accepted the appeals filed by Colau and Sanz even though it had not observed signs of fraud in the subsidies or misappropriation of funds.

A conviction that Acebillo brought before the TS, which rejected the complaint filed by the former chief architect and ordered him to pay court costs.

In a statement from BComú, Sanz celebrated the decision: “The TS confirmed that the entire green transformation project of Superilla Barcelona was developed in accordance with the law and that there is no criminal offense. “

According to him, the project promotes sustainability, enjoys a positive evaluation from citizens and is now “approved by the TS”.
