The possible indictment of José Luis Ábalos in the Koldo case is currently being processed. The Congress of Deputies confirmed last Friday, in a letter addressed to the judge of the National Court Ismael Moreno, that José Luis Ábalos is a deputy in the Lower House. The President of Congress responded in writing to the instructor’s request, certifying that the former Minister of Transport retains his seat and is therefore qualified.

This procedure could be the first step towards the possible indictment of Ábalos in the Koldo case. After receiving the report from the Central Operational Unit (UCO) of the Civil Guardthe judge in charge of investigating the case took the preliminary step of indicting the former Minister of Transport for the conspiracy to purchase masks during the pandemic, that is, addressing Armengol for ask him if Ábalos is a deputy and therefore qualified.

After receiving a response from the Cortes on Ábalos’ status as a judge, the judge will be able to submit to the Supreme Court a reasoned declaration with all the evidence he has collected on the alleged involvement of the former minister in the conspiracy. It will be the Second Chamber of the Superior Court, the only one competent to investigate Ábalos due to his status as a certified person, which will decide whether there are sufficient reasons to open a criminal case against him.
