Court requests to see entire Peinado v. Gómez trial to decide if it is a “general cause”

This was decided by Section 23 of the Court, two weeks after the date set to rule on the appeals filed by Begoña Gómez’s defense and the prosecutor against the resolution in which Peinado would have specified the purpose of the proceedings.

At the request of defense attorney Antonio Camacho, Peinado indicated that the object of the investigation are “all the acts, conduct and behavior” of Begoña Gómez “since her husband has been president of the government, contained in the initial complaint” filed by the union.

For the defense and the prosecution, the vagueness of this response is the closest thing to a “general cause” against the person investigatedwhat the legal system prohibits.

It also happens that the Court itself has limited the investigation into the complaint of Manos Liminas to the contracts awarded to the companies of Juan Carlos Barrabés, which passed from the Peinado Tribunal to the European Public Prosecutor’s Office.

The Provincial Court of Madrid has set September 30 for the resolution of the appeals of the prosecutor and Gómez’s defense. The latter requests that the proceedings be archived given the absence, according to it, of any evidence of a crime.

Although the Court will only be able to rule on the specific questions raised by these resources —In short, whether the object of the procedure as defined by the investigating judge is in accordance with the law or not.—Being able to examine the entire file will allow magistrates have a complete vision of a very questioned instruction and which led to the filing of two complaints against Peinado, one from the president of the government himself, Pedro Sánchez, and the other from Gómez.

These appeals were presented in early July, before the judge made decisions such as summoning Sánchez to testify or transforming the status of Barrabés and the rector of the Complutense University, Joaquín Goyache, from witnesses to persons under investigation.
